I would appreciate the following comments be read into the record concerning the subject agenda item - With respect to agenda item 7.1, this statement is specific to the flag pole in front of the Veterans Memorial Building on Hartz Ave. from the Commander of American Legion Mt. Diablo Post 246, an original resident VSO in that building since 1925. The American Legion, under national charter by the Congress of the United States and as a 501(c)19 non-profit veterans organization, is and must remain an apolitical organization as do all other VSOs resident in the Veterans Memorial Building. It is acknowledged that the American Legion and the other VSOs do not "own" the building but it is held in trust for veterans. As such the flag pole is tacitly, if not explicitly, associated with veterans and their organizations. Therefore, the flying of any flags other than the American flag, the California flag, and the POW/MIA flag on the flag pole at the Veterans Memorial Building has not in the past and must not be allowed or otherwise permitted in the future. I strongly recommend that any council resolution or ordinance regarding flags codify this prohibition. Eric Ardell Commander American Legion Mt. Diablo Post 246 1
