SUBJECT: Resolution No. 43-2020, approving a Notice of Completion for the Hap
Magee Ranch Park Playground Renovation Project, CIP No. B-400
BACKGROUND
The Hap Magee Ranch Park Playground Renovation Project, Contract No. B-400, included
demolition of existing pavement, walls, landscaping, minor earthwork, and installation of
new concrete, decomposed granite paving, resilient surfacing, sand play area, play
equipment, fencing, and site furnishings. As a change order, the contractor also performed
work at Osage Station Park, which consisted of new asphalt around the tennis courts,
repaving most of the existing trail, and installing new landscaping at the south parking lot.
DISCUSSION
The project is now complete and ready for acceptance by the Town. All work was performed
in accordance with the approved plans and specifications.
The original contract amount of $713,770.50 was increased by $192,060.10 as a result of 6
Contract Change Orders. The change orders consisted of repairing and repainting the barn
façade and removing and replacing the roof at the entry portal at Hap Magee Ranch Park.
In addition, the change orders enabled the contractor to undertake work at Osage Station
Park including repaving an existing portion of the trail, installing a new asphalt path around
existing tennis courts, and adding new landscape at the south parking lot.
The final contract amount of $905,830.60 (contract plus change orders) is within the
authorized construction budget for this project.

RESOLUTION NO. 43-2020
APPROVING A NOTICE OF COMPLETION FOR THE HAP MAGEE RANCH
PARK PLAYGROUND RENOVATION PROJECT, CIP NO. B-400
WHEREAS, on June 18, 2019, the Town of Danville awarded a construction contract to
Suarez and Munoz Construction, Inc., for the Hap Magee Ranch Park Playground
Renovation Project, CIP No. B-400; and
WHEREAS, the City Engineer has determined that the work under this project was
completed as of May 1, 2020, in accordance with the plans and specifications thereof; and
WHEREAS, California Civil Code section 9204 specifies the requirements for recordation
of a Notice of Completion; and
WHEREAS, not less than thirty days (30) nor more than forty-five (45) days after a Notice
of Completion is recorded the Town must release all undisputed retention payments to
the contractor; now, therefore be it
RESOLVED, by the Danville Town Council that said work by and with Suarez and
Munoz Construction, Inc., is hereby accepted as complete; and, be it further
RESOLVED, that the City Clerk is hereby authorized and directed to file with the County
Recorder of the County of Contra Costa, a Notice of Completion for said project within
fifteen (15) days from the date hereof; and, be it further
RESOLVED, that undisputed retention payments be released in accordance with
Sections 8812 and 9356 of the California Civil Code.
