HomeMy WebLinkAbout061620-05.05TO: ADMINISTRATIVE STAFF REPORT 5.5 Mayor and Town Council June 16, 2020 SUBJECT: Resolution No. 40-2020, requesting and consenting to consolidation of elections and setting specifications of the election order for the November 3, 2020 Municipal Election BACKGROUND A municipal election will be held in Danville on November 3, 2020 to elect three members to the Danville Town Council for four-year terms. The Contra Costa County Elections Division traditionally administers Danville's Municipal Elections. July 1, 2020 is the deadline for submitting a formal request to the Contra Costa County Elections Division to administer Danville's Election on November 3, 2020. In addition to requesting consolidation, the Contra Costa County Elections Division requires that the Town Council resolution include policies for candidate statements including: the number of words the candidate statement can contain; who will pay for the candidate statement; whether the fee for the candidate statement must be paid at the time of filing; and, action to be taken in the case of a tie vote. DISCUSSION The practice established for previous Town Council elections has allowed for a 250 -word statement and required the candidate to pay the cost of publishing the statement. This year, the Contra Costa County Elections Division has determined that the cost to print a 250 -word candidate statement is $660. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT Based on a current registered voter population of 30,990, and an estimated cost of $1.25- $1.75 per registered voter, the Contra Costa County Elections Division has estimated that the cost of the election is approximately $38,737 to $54,233. Final costs will be determined following the election and varies depending upon the number of agencies that consolidate. The cost to conduct the election is anticipated to be shared among other agencies, including the San Ramon Valley Fire Protection District, San Ramon Valley Unified School District, and the Central Contra Costa Sanitary District. All costs associated with the production of the candidate statements will be borne by the candidate. RECOMMENDATION Adopt Resolution No. 40-2020, requesting and consenting to consolidation of elections and setting specifications of the election order for the November 3, 2020 Municipal Election. Marie Sunseri City Clerk Attachment: Resolution No. 40-2020 2020 Municipal Election 2 June 16, 2020 DocuSign Envelope ID: 2430FEB2-8E2A-432F-981A-A1023D1 D73AC RESOLUTION NO. 40-2020 REQUESTING AND CONSENTING TO CONSOLIDATION OF ELECTIONS AND SETTING SPECIFICATIONS OF THE ELECTION ORDER FOR THE NOVEMBER 3, 2020 MUNICIPAL ELECTION WHEREAS, the Town Council has ordered a Municipal Election to be held on Tuesday, November 3, 2020 to fill certain municipal offices; and WHEREAS, other elections may be held in whole or in part in the incorporated area of the Town of Danville and it is to the advantage of the Town to consolidate pursuant to Elections Code Section 10002; and WHEREAS, Elections Code Section 10002 requires the Town to reimburse the County in full for the services performed upon presentation of a bill to the Town by the County Elections Official; and WHEREAS, Elections Code Section 13307 requires that before the nominating period opens, the Town Council must determine whether a charge shall be levied against each candidate submitting a candidate statement to be sent to the voters; and may establish the cost; and determine whether the cost be paid in advance; and WHEREAS, Elections Code Section 12101 requires the publication of a notice of the election once in a newspaper of general circulation in the Town; and WHEREAS, tie votes shall be determined by lot unless the Town Council adopts the provisions of Elections Code 15651(b) prior to the conduct of the election resulting in the tie vote; now, therefore, be it RESOLVED, by the Danville Town Council that an election be held in accordance with the following specifications: 1. The Election shall be held on Tuesday, November 3, 2020. The purpose of the election is to choose successors for three seats on the Danville Town Council for four-year terms; and 2. The Town Council hereby requests and consents to the consolidation of this election with other elections which may be held in whole or in part of the Town of Danville, as provided in Elections Code Section 10002; and 3. The Town will reimburse Contra Costa County for the actual cost incurred in conducting the election upon receipt of an invoice stating the amount due as determined by the elections official; and 4. The candidate statement will be limited to 250 words and the candidate will pay $660, the cost of publishing the candidate statement, at the time of filing. The City Clerk is to publish the Notice of Election in the East Bay Times, a newspaper of general circulation published daily in the Town of Danville; and 6. In the event of a tie vote, the tie will be determined by lot; and 7. The Town Council directs that a certified copy of this Resolution be forwarded to the Registrar of Voters and to the Board of Supervisors of Contra Costa County.
