SUBJECT: Resolution No. 33-2020, authorizing application for, and receipt of,
Local Early Action Planning (LEAP) Grants Program Funds
BACKGROUND
In the 2019-20 Budget Act, Governor Newsom allocated 250 million for all regions, cities,
and counties to do their part by prioritizing planning activities that accelerate housing
production to meet identified needs of every community. With this allocation, the
California Department of Housing and Community Development (HCD) established the
LEAP grant with $119 million funding for cities and counties.
LEAP is made available as part of the Local Government Planning Supports Grant Program
pursuant to Health and Safety Code Section 50515.03, et. Seq. LEAP provides one-time grant
funding to cities and counties for the preparation and adoption of planning documents,
process improvements that accelerate housing production, and facilitate compliance in
implementing the 6th cycle of RHNA much like SB2 Planning Grants.
DISCUSSION
LEAP grant funding is based on community size. Danville and similarly sized communities
are eligible for up to $150,000, in LEAP grant funds. HCD has published a Notice of Funding
Availability, which requires eligible cities to file an application with HCD by July 1, 2020.
The grant procedures require authorization from the Town Council for the Town Manager
or their designee to submit the LEAP application.
Danville’s LEAP application includes the need to retain an environmental consultant to
prepare a program level Environmental Impact Report, pursuant to the California
Environmental Quality Act (CEQA), which will be necessary to support the Towns’
adoption of the upcoming 2022-2030 Housing Element.
The upcoming RHNA requirements related to the next housing cycle are in the process of
being established. As with each RHNA cycle, the Town will need to study and identify
feasible sites that could be planned for multi-family housing. This will include the need to
address CEQA through studying potential environmental impacts related to aesthetics, air
quality, biological resources, cultural and paleontological resources, geology and soils,

hazards and hazardous materials, hydrology and water quality, noise, population and
housing, public services, utilities and service systems, recreation, and transportation/traffic.
Potential LEAP funds would be used for this purpose.

FISCAL IMPACT
Acquisition of LEAP program funding from State HCD would reduce Town expenditures
from the General Fund and/or other Special Purpose revenue funds by $150,000.
RECOMMENDATION
Adopt Resolution No. 33-2020, authorizing application for, and receipt of, Local Early
Action Planning (LEAP) Grants Program Funds.

RESOLUTION NO. 33-2020
A RESOLUTION OF THE TOWN COUNCIL OF DANVILLE AUTHORIZING
APPLICATION FOR, AND RECEIPT OF, LOCAL GOVERNMENT PLANNING
SUPPORT GRANT PROGRAM FUNDS
WHEREAS, pursuant to Health and Safety Code 50515 et. Seq, the Department of
Housing and Community Development (Department) is authorized to issue a Notice of
Funding Availability (NOFA) as part of the Local Government Planning Support Grants
Program (hereinafter referred to by the Department as the Local Early Action Planning
Grants program or LEAP); and
WHEREAS, the Town Council of Danville desires to submit a LEAP grant application
package (“Application”), on the forms provided by the Department, for approval of grant
funding for projects that assist in the preparation and adoption of planning documents
and process improvements that accelerate housing production and facilitate compliance
to implement the sixth cycle of the regional housing need assessment; and
WHEREAS, the Department has issued a NOFA and Application on January 27, 2020 in
the amount of $119,040,000 for assistance to all California Jurisdictions;
Now, therefore, the Town Council of Danville (“Applicant”) resolves as follows:
SECTION 1. The Town Manager is hereby authorized and directed to apply for and
submit to the Department the Application package.
SECTION 2. In connection with the LEAP grant, if the Application is approved by the
Department, the Town Manager of the Town of Danville is authorized to submit the
Application, enter into, execute, and deliver on behalf of the Applicant, a State of
California Agreement (Standard Agreement) for the amount of $150,000, and any and all
other documents required or deemed necessary or appropriate to evidence and secure
the LEAP grant, the Applicant’s obligations related thereto, and all amendments thereto;
and
SECTION 3. The Applicant shall be subject to the terms and conditions as specified in
the NOFA, and the Standard Agreement provided by the Department after approval.
The Application and any and all accompanying documents are incorporated in full as
part of the Standard Agreement. Any and all activities funded, information provided,
and timelines represented in the Application will be enforceable through the fully
executed Standard Agreement. Pursuant to the NOFA and in conjunction with the terms
of the Standard Agreement, the Applicant hereby agrees to use the funds for eligible uses
and allowable expenditures in the manner presented and specifically identified in the
approved Application.
