CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Vice Mayor Blackwell at 7:30 p.m., in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Lisa Blackwell, Vice Mayor Newell Arnerich, Councilmember Renee Morgan, Councilmember Robert Storer, Councilmember Excused: Karen Stepper, Mayor 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Town Manager Joe Calabrigo. 3. CHANGES TO THE ORDER OF THE AGENDA Town Manager Joe Calabrigo stated that item 6.5 is being continued to a date uncertain at the request of the property owner. Mr. Calabrigo stated that pursuant to Government Code Section 54954.2(b)(2), Town staff was asking to add agenda items 6.7 and 6.8 to the agenda as urgency items. The urgency is as follows: the need for action arose after the posting of the agenda on March 12, with the six -county Health Order being issued only yesterday, March 16, at noon. Due to the spread of the COVID-19 virus and the need to comply with the various federal, state and county orders to ensure public safety, these items cannot wait until the next Town Council meeting on April 7, 2020. This item requires a 2/3 vote of the Town Council to add it to the agenda. CONSENT CALENDAR Item 6.5 was continued to a date uncertain. 6.1 Consider approval of the Summary of Actions from the regular Town Council meeting of March 4, 2020 6.2 Consider approval of the Register of Demands 6.3 Consider acceptance of the January 2020 Month End Treasurer's Report 6.4 Consider adoption of Resolution No. 17-2020, designating the District Engineer, directing preparation of the annual report for the Danville Street Lighting and Landscape Assessment District 1983-1 and approving a contract extension with Francisco and Associates 6.5 Consider adoption of Resolution No. 18-2020, designating the Fazzio/Fisher House as a Danville Heritage Resource and approving a Historic Preservation Incentive Package for the historic structure located at 342 Railroad Avenue CONTINUED TO A DATE UNCERTAIN 6.6 Consider adoption of Resolution No. 19-2020, appropriating $160,000 in reimbursable funding to develop the Permit -Ready Granny Unit Program MOTION BY COUNCILMEMBER STORER, SECOND BY COUNCILMEMBER MORGAN, TO APPROVE THE CONSENT CALENDAR ITEMS 6.1 THROUGH 6.6, WITH THE EXCEPTION OF ITEM 6.5 MOTION CARRIED 4-0-0-1; MAYOR STEPPER ABSENT 2 DocuSign Envelope ID: 1371CBE5-B592-4A27-AD56-EEDE728C00A0 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MARCH 17, 2020 ITEM 6.7 - Consider adoption of Resolution No. 21-2020, proclaiming the existence of a local emergency within the Town of Danville in response to the Novel Coronavirus designated as COVID-19 ADDED AS URGENCY ITEM Town Manager Joe Calabrigo presented the staff report and stated that the Town Council is being asked to approve a Declaration of Local Emergency for the Town of Danville in response to the evolving threat of the novel coronavirus. The declaration would authorize the Emergency Services Director to determine which Town services are essential governmental functions that will continue during the length of the order, designate employees and contractors necessary to perform the essential functions, and determine which Town facilities must remain open. In addition, it places a stay on the Town's normal procurement and purchasing policies in favor of the Town's emergency procurement policies for the duration. The emergency declaration will continue until terminated by action of the Town Council. He explained that, with the measures put into place by Contra Costa County, and the State of California, it would be prudent for the Town to adopt the emergency declaration. Given these restrictions, the presence of the virus in Contra Costa County, and the need to preserve public health, it is appropriate for the Town Council to declare a local emergency. MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER MORGAN, TO ADOPT RESOLUTION NO. 21-2020, PROCLAIMING THE EXISTENCE OF A LOCAL EMERGENCY WITHIN THE TOWN OF DANVILLE IN RESPONSE TO THE NOVEL CORONAVIRUS DESIGNATED AS COVID-19 MOTION CARRIED 4-0-0-1 ITEM 6.8 - Consider adoption of Ordinance No. 2020-02, an urgency ordinance of the Town of Danville suspending automatic deemed complete and approval deadlines for all land use, subdivision, and zoning applications ADDED AS URGENCY ITEM City Attorney Rob Ewing presented the staff report and stated that the ordinance would suspend timelines set forth in state planning law. It is of concern because there are very specific timelines on applications and there are consequences if the timelines are not met. The ordinance would suspend the timelines during the local emergency. The Planning Commission and Design Review Board meetings are being cancelled due to the local emergency and there are no means to accommodate the public review process. As of today, all timelines would be frozen until the emergency is lifted by action of the Town Council. The ordinance would go into effect immediately, with no second reading. MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER STORER, TO ADOPT ORDINANCE NO. 2020-02, AN URGENCY ORDINANCE OF THE TOWN OF DANVILLE SUSPENDING AUTOMATIC DEEMED COMPLETE AND APPROVAL DEADLINES FOR ALL LAND USE, SUBDIVISION, AND ZONING APPLICATIONS MOTION CARRIED 4-0-0-1 7. COMMUNICATIONS 7.1 Town Manager's update Town Manager Joe Calabrigo provided an update on the status of Town services, given the COVID19 pandemic. 8.
