SUBJECT: Development Plan request to allow three retractable awnings and an
affixed awning in the front entry of the business Yo’s on Hartz located at
531 Hartz Avenue
PROJECT DESCRIPTION
The Development Plan request (DEV19-0021) would allow for three retractable awnings
that measure approximately twenty (20) feet by nine (9) feet to be attached to the existing
wall to cover the outdoor seating area and allow for an affixed awning in the front entry
of the restaurant.
EVALUATION
Conformance with General Plan and Zoning District
The site has a General Plan land use designation of DBD1; Downtown Business District
Area 1. The proposed project meets objective development standards for the subject
zoning district including height restrictions (10’ while 35’ is allowed). The proposed
project consists of exterior façade modifications to the existing restaurant, Yo’s on Hartz,
that would add three retractable awnings that measure approximately 520 square feet.
There are no minimum setback requirements for the side and rear yard. The setback
requirement for the front yard shall be an average of ten (10) feet minimum under land
use designation DBD1. The current building is five (5) feet away from the property line
and the affixed awning would encroach an additional 2’-5” into the front yard setback
where the stairs are currently located.
Issues to Discuss
• The retractable and affixed awnings would allow for protection from the elements.
The retractable awnings would allow for the outdoor seating area to be covered,
thus creating a more flexible dining experience.
• The affixed awning at the front patio has been proposed in order to address the
issue of the stairs becoming a hazard during inclement weather.

• Staff recommends that the steel post located at the front entry for the affixed
awning be 4”x 4” column posts.
RECOMMENDATION
Recommend approval of the architectural and site plan design to allow three retractable
awnings and an affixed awning in the front entry of the business Yo’s on Hartz located
at 531 Hartz Avenue.

SECTION 3I05 AWNINGS AND CANOPIES
3105.1 General. Awnings or canopies shall
comply with the requ¡rements of this section and
other applicable sect¡ons of this code.
3105.2 Definition. The following term shall, for the
purposes of this sect¡on and as used elsewhere in
this code, have the meaning shown herein.
3105.3 Design and construction. Awnings and
canop¡es shall be designed and constructed to
withstand wind or other lateral loads and live
loads as requ¡red by Chapter 16 with due
allowance for shape, open construction and
similar features that relieve the pressures or
loads. Structural members shall be protected to
prevent deterioration. Awnings shall have frames
of noncom bu sti ble material, fi re-retardant-treated
wood, wood of Type lV size, or 1-hour
construction with combust¡ble or noncombustible
covers and shall be either fixed, retractable,
folding or collapsible.
3105.4 Canopy materials. Canopies shall be
constructed of a rigid framework with an approved
cover¡ng that meets the fire propagation
performance cr¡teria of NFPA 701 or has a flame
spread index not greater than 25 when tested in
accordance w¡th ASTM E 84 or UL 723. All
fabrics and all interior decorative fabrics or
materials shall be flame resistant in accordance
with appropr¡ate standards set forth in CCR, Title
19, Division 1, Chapter 8. Tops and sidewalls
shall be made either from fabric which has been
flame resistant treated with an approved exterior
chemical process by an approved application
concern, or from inherently flame resistant fabric
approved and listed by the State Fire Marshal
(see CCR, Title 19, Division 1 , Chapter 8).
3202.2.3 Awnings. The vertical clearance from
the public right-of-way to the lowest part of any
awning, including valances, shall be 7 feet (2134
mm) minimum.

3102.3 Type of Construction. Non-combustable membrane
structures shall be classified as Type llB construction.
Non-combustable frame or cable-supported structures covered by
an approved membrane in accordance with Section 3102.3.1 shall
be classified as Type llB construction.
