SUMMARY OF ACTIONS
FEBRUARY 18, 2020
1. CALL TO ORDER
The regular meeting of the Danville Town Council was called to order by Mayor
Stepper at 7:30 p.m., in the Town Meeting Hall, 201 Front Street, Danville, CA.
Present: Karen Stepper, Mayor
Lisa Blackwell, Vice Mayor
Newell Arnerich, Councilmember
Renee Morgan, Councilmember
Robert Storer, Councilmember
2. PLEDGE OF ALLEGIANCE TO THE FLAG
The pledge of allegiance to the flag was led by Girl Scout Troop 30168, Greenbrook
Elementary School, Lindsay Coffin and Dora Beig, leaders.
3. CHANGES TO THE ORDER OF THE AGENDA
Town Manager Joe Calabrigo stated that minor revisions were made to agenda
item 5.1 and the CIP page attached to agenda item 5.5 was corrected. Updated
documents were distributed.
4. FOR THE GOOD OF THE TOWN
There were no speakers.
5. CONSENT CALENDAR
Agenda item 5.4 was removed for public comment.
5.1 Consider approval of the Summary of Actions from the regular Town
Council meeting of February 4, 2020 REVISED
5.2 Consider approval of the Register of Demands
5.3 Consider acceptance of the December 2019 Month End Treasurer's
Report

5.4 Consider adoption of Ordinance No. 2020-01, amending Section 7-6 of
the Danville Municipal Code regulating tobacco retailing, advertising

MORGAN TO APPROVE THE CONSENT CALENDAR, INCLUDING REVISIONS TO
ITEMS 5.1 AND 5.5; WITH THE EXCEPTION OF ITEM 5.4

ITEM 5.4 - CONSIDER ADOPTION OF ORDINANCE NO. 2020-01, AMENDING
SECTION 7-6 OF THE DANVILLE MUNICIPAL CODE REGULATING TOBACCO
RETAILING, ADVERTISING AND PROMOTION, AND BANNING THE SALE OF
ELECTRONIC SMOKING DEVICES REMOVED FOR PUBLIC COMMENT
Mayor Stepper opened the item to public comment.
Lori Garcia, Danville, commended the Town for efforts to regulate tobacco and
ban the sale of electronic smoking devices and requested that the Town reconsider
banning the sale of flavored tobacco products.
Myra Lopez, Contra Costa County Department of Public Health Tobacco
Prevention Program, encouraged the Town to consider banning the sale of
flavored tobacco products.
Patty Hoyt, Discovery Counseling Center, encouraged the Town to consider
banning the sale of flavored tobacco products.

Mayor Stepper closed the item to public comment.
Councilmember Morgan stated that the discussion regarding flavored tobacco products
will take place at a future Town Council study session.
MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER
STORER, TO ADOPT ORDINANCE NO. 2020-01, AMENDING SECTION 7-6 OF THE
DANVILLE MUNICIPAL CODE REGULATING TOBACCO RETAILING,
ADVERTISING AND PROMOTION, AND BANNING THE SALE OF ELECTRONIC
SMOKING DEVICES, AS PRESENTED, AND DISCUSS THE BANNING OF THE SALE
OF FLAVORED TOBACCO PRODUCTS AT A FUTURE TOWN COUNCIL STUDY
SESSION
MOTION CARRIED 5-0
6. COMMUNICATIONS
6.1 City Clerk Marie Sunseri announced the recruitment for the following:
a. Arts Advisory Board: One (1) Youth Member for two-year term ending
June 30, 2022
b. Contra Costa County Advisory County on Aging: One (1) Danville
representative for two-year term ending June 30, 2022
c. Heritage Resource Commission: One (1) regular member (architect) for
a term ending December 31, 2023
7. ADMINISTRATIVE STAFF REPORTS
7.1 Consider adoption of Resolution No. 14-2020, adopting a policy
establishing residential development standards
Principal Planner David Crompton presented the staff report.
Councilmember Morgan asked if a condition can be included requiring
a specialist to be consulted to assess rodent control impacts upon
issuance of a grading permit.
Mr. Crompton responded affirmatively and stated that the requirement
can be added as a development standard.

Councilmember Storer asked if a Town Council study session would
count toward the total number of meetings for a project.
Town Manager Joe Calabrigo stated that a study session is a publicly
noticed meeting and would be one of the five maximum meetings
allowed.

STORER, TO ADOPT RESOLUTION NO. 14-2020, ADOPTING A POLICY
ESTABLISHING RESIDENTIAL DEVELOPMENT STANDARDS

7.2 Consider adoption of Resolution No. 15-2020, accepting the mid -year
Financial Report and approving mid -year adjustments to the Fiscal Year
2019/20 Operating Budget
Town Manager Joe Calabrigo presented the staff report and introduced
Finance Manager/Treasurer Lani Ha. He stated that the Town Council
reviewed the report at the Town Council annual workshop. He
reviewed the proposed modifications and noted that there is a
modification recommended to the Town's Master Fee Schedule to
increase the fees for the Electric Vehicle charging stations, as the
charging stations are currently being operated by the Town at a deficit.

8.1 Appoint one member of the Parks, Recreation and Arts Commission to
the Arts Advisory Board to fulfill a term ending June 30, 2021
