HomeMy WebLinkAbout011420-05.4 ADMINISTRATIVE STAFF REPORT 5.4 TO: Mayor and Town Council January 14, 2020 SUBJECT: Resolution No. 1-2020, approving a Notice of Completion for the Front Street Creek Bank Stabilization Project, CIP No. C-593 BACKGROUND The segment of Front Street located north of Diablo Road has been impacted by the failure of the adjacent creekbank along the west side of San Ramon Creek. The heavy winter rains that occurred in December 2014 resulted in the collapse of a section of the creekbank, undermining the guardrail, curb and gutter, pavement, and a utility pole on Front Street. The collapse necessitated the installation of temporary concrete barriers along Front Street, narrowing the roadway width and limiting on-street parking. This project included construction of a retaining wall to support the road surface, while stabilizing the creekbank utilizing riprap, erosion control fabric and landscaping. DISCUSSION The project is now complete and ready for acceptance by the Town. All work was performed in accordance with the approved plans and specifications. The original contract amount of $657,040.50 was increased by $38,308.87 as a result of three Contract Change Orders, for a total of $695,349.37. The change orders consisted of additional irrigation, extending paving on Front Street and adjustment of final bid quantity measurements. The final contract amount of $695,349.37 (contract plus change orders) is within the authorized construction budget for this project. C-593 WHEREAS, on July 17, 2018, the Town of Danville awarded a construction contract to Jim Freethy Excavating, Inc., for the Front Street Creek Bank Stabilization Project, CIP No. C-593; and WHEREAS, the City Engineer has determined that the work under this project has been completed as of September 20, 2019, in accordance with the plans and specifications thereof; and WHEREAS, California Civil Code section 9204 specifies the requirements for recordation of a Notice of Completion; and WHEREAS, not less than thirty days (30) nor more than forty-five (45) days after a Notice of Completion is recorded, the Town must release all undisputed retention payments to the contractor; now, therefore, be it RESOLVED, by the Danville Town Council that said work by and with Jim Freethy Excavating, Inc., is hereby accepted as complete; and, be it further RESOLVED, that the City Clerk is hereby authorized and directed to file with the County Recorder of the County of Contra Costa, a Notice of Completion for said project within fifteen (15) days from the date hereof; and, be it further RESOLVED, that undisputed retention payments be released in accordance with Sections 8812 and 9356 of the California Civil Code. C-593 WHEREAS, a storm on December 12, 2014 caused a landslide in San Ramon Creek that damaged the east edge of Front Street in downtown Danville; and WHEREAS, funding for the repair of the landslide has been appropriated for CIP No. C- 593 in the Town's adopted Capital Improvement Program; and WHEREAS, the plans and specifications for the proposed work have been reviewed and approved by the City Engineer; and WHEREAS, the City Clerk of this Town did, in open session on the 11th day of July, 2018, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the lowest responsive bidder is Jim Freethy Excavating Inc. of Danville, California, at $657,040.50 and the City Engineer has recommended awarding a construction contract for the project to said contractor; and WHEREAS, a Mitigated Negative Declaration was prepared in accordance with the California Environmental Quality Act; now, therefore, be it RESOLVED, by the Danville Town Council, that $170,000 in General Purpose Revenue be appropriated in Fiscal Year 2018/ 19 for CIP No. C-593 to fund construction of the project; and, be it further RESOLVED, by the Danville Town Council, that the Town award the construction contract for the Front Street Creek Bank Stabilization Project, CIP No. C-593 to Jim Freethy Excavating Inc. of Danville, California; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute, on behalf of the Town, a written contract with Jim Freethy Excavating Inc. of Danville, California for $657,040.50 and authorize use of a 10% contingency amount of $66,000 for a total construction budget $723,040.50 for work in connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and, be it further ATTACHMENT C RESOLVED, that the Town shall within five (5) days of the adoption of this resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. Note: Should a finding of any discrepancy regarding this ratio of apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings.)
