and WHEREAS, the project, after provision of a density bonus, w uld have a developm nt density of 3.56 units per acre, w th the density bonus being linked to an applicant com tment to provide eight attached <550 square foot accessory dw Ming units (i.e., second dw Ming units hereafter referred to as A in the project as housing appropriate for low incom households; and WHEREAS, the 5.05 -acre subject property is located at the southern corner of the intersection of Cam no Tassajara and Sherburne H Ils Road, being further identified as 2550 Camino Tassajara and as A sessor's Parcel N m er A N 217-010-008; and WHEREAS, the Tow deem d these applications com Tete on February 15, 2019, and WHEREAS, these approvals w uld serve to rezone the property from a P-1; Planned U it D velopment D strict to the proposed new P-1; Planned U it D velopm nt D strict and w uld approve the subdivision of the 5.05 acre site to be developed as an 18 -lot single fam ly residential project w th associated com now ership parcels; and WHEREAS, these approvals w uld also serve to obligate the applicant to m ke provision of eight attached <550 square foot A in the project, being an A w thin eight of the eighteen approved prim ry residential units, to satisfy the project's density bonus requirements; and WHEREAS, these approvals w uld also provide for final architectural design and landscape details for the developm nt, w uld authorize the rem val of seven Tow - protected trees, and w uld allow construction activity in proxim ty to additional onsite and offsite Tow -protected trees; and WHEREAS, the D nville Tree Preservation 0 dinance requires approval of a Tree Rem val perm t prior to the rem val of Tow -protected trees; and WHEREAS, the developm nt applications m et the definition of a "project" under the California Environm ntal Q ality A t (CEQ and the Tow of D nville, upon com letion of an Initial Study and Environm ntal Checklist (Initial Study) for the project, determ ned that adoption of a M tigated N gative D claration of Environm ntal Significance w s appropriate for the project; and WHEREAS, to solicit review and input from the public and interested agencies on the M the Tow of D nville prepared and circulated a N tice of Intent to A opt a M tigated N gative D claration of Environm ntal Significance (M for the project on M rch 19, 2019, for a 21 -day review period ending on A ril 9, 2019; and WHEREAS, on A ril 9, 2019, the Planning Com ssion held a public hearing on the M and the project and received testim ny from the public at the hearing; and WHEREAS, a staff report w s subm tted recom nding that the D nville Planning Com ssion approve Planning Com ssion Resolution N . 2019-03 to recom end the Tow Council adopt the M and approve the developm nt applications; and WHEREAS, the Planning Com ssion closed the public hearing and approved Resolution N . 2019-03; and WHEREAS, the Tow Council review d the project at a noticed public hearing on M y 7, 2019; and WHEREAS, a public notice of the public hearing w s given in all respects as required by law and WHEREAS, after conclusion of the public hearing on the M and the project, the Tow Council determ ned that the D aft M has been prepared in com liance w th CEQ and WHEREAS, prior to taking an action on the project the Tow Council review d and considered the inform tion contained in the M and the testim ny presented at the public hearing; and WHEREAS, prior to taking action the Tow Council declares that it has heard and been presented w th, review d, and considered all of the inform tion and data in the adm nistrative record, including the M and other docum ntation relating to the project; now therefore, be it RESO VED that the Tow Council adopts the M tigated N gative D claration of Environmental Significance and approves Prelim nary D velopm nt Plan - Rezoning request PU 18-01, Vesting Tentative M p request SD 9479, Final D velopment Plan request DEV 18-09, and Tree Rem val request TR 18-26, authorizing the project site's subdivision into 18 single fam ly residential lots and associated parcels, and approves the proposed project architecture and landscaping per the conditions herein, and makes the follow ng findings in support of this action: FIN N SO A PRO Prelim nary D velopm nt Plan - Rezoning 1. he proposed rezoning of the site to P-1; Planned U it D velopm nt D strict (PUD is consistent w th the D nville 2030 G neral Plan. The proposed residential developm nt is, w th the granting of the requested density bonus, within the perm tied developm nt density under the property's Residential - Single Fam ly - Low D nsity (1-3 units per acre) land use designation. 2. he project site is identified as a Special Concern A ea in the G neral Plan. A m dified by the proposed conditions of approval, the project w 11 be consistent w th the G neral Plan language for the Tassajara Lane/Sherburne H Ils Special Concern A ea found on Pages 3-51 and 3-52 of the D nville 2030 G neral Plan. 3. he proposed uses are com atible w th property's proposed P-1; Planned U it D velopm nt D strict zoning designation and the uses authorized by zoning on adjacent and neighboring properties. The proposed infill housing is an efficient developm nt pattern consistent w th surrounding residential subdivisions and w 11 add to existing infrastructure that services the adjacent single fam ly residential uses. Final D velopm nt Plan - Major Subdivision 1. he proposed subdivision is in conform nce w th the goals and policies of the D nville 2030 G neral Plan and the site's Residential - Single Fam ly - Low D nsity (1-3 units per acre) land use designation. 2. he design of the proposed subdivision is in conform nce w th the P-1; Planned U it D velopm nt D strict since the subject P-1; Planned U it D velopm nt D strict is custom zed to the subject Prelim nary and Final D velopm nt Plans. The P-1; Planned U it D velopm nt D strict is an appropriate zoning designation for infill projects and lands designated as Special Concern A eas in the G neral Plan. A ditional detailed findings regarding P-1 zoning consistency can be found under Prelim nary D velopm nt Plan - Rezoning above. 3. he design of the subdivision and the type of associated im rovem nts w 11 not likely cause serious public health problem , because w ter and sanitary facilities and services w 11 be available to the proposed lots. 4. he density of the subdivision is physically suitable for the subject site and surrounding neighborhood because the proposed developm nt is sim lar in size and density to the residential developm nts adjacent and vicinity of the site. 5. he design of the proposed subdivision and im rovem nts are not likely to cause substantial environm ntal dam ge or subsequently injure fish or w ldlife or their habitat, in part because the project site is w thin an area w ere development has previously occurred. The M tigated N gative D claration of Environm ntal Significance prepared for the project found that, w th project m difications m de during project review and w th im lem ntation of recom nded m tigation PA 4 0 RESO U IO N 31-2019 DocuSign Envelope ID: 34331802-5C7C-47E2-AADC-B8AFAF6CBBDC m asures, the project w uld have no significant negative im acts on the w ldlife on site. 6. he design of the proposed subdivision and proposed im rovem nts would not conflict w th easem nts, acquired by the public at large, for access through or use of, property w thin the proposed subdivision. There are currently no existing public easem nts for access through or use of the subject properties. Through project conditions of approval, the subdivision w 11 offer new easem nts for public access. 7. he project w 11 not cause on-site flooding or add to existing dow stream flooding. The pplicant 11 e equired o repare nd ubm t detailed hydrology/ hydraulic report for the project in conjunction w th the initial subm ttal of project im rovem nt plans and subm ttal of the Final Storm ter Control Plan. The applicant w 11 be required to docum nt that requisite review and approval of these docum nts, w th a focus on the project's hydro m dification requirem nts, has been m de by the Contra Costa County Flood Control and Water Conservation D strict. Tree Removal Perm t The project, as proposed, w uld rem ve 37 of the 71 surveyed onsite and offsite trees. O the trees to be rem ved, seven are designated as protected trees under the Town's Tree Preservation O dinance. The findings below address only the seven trees designated as protected under the Tow 's Tree Preservation O dinance. The conditions of approval for the project present m tigation m asures to address the rem val of these trees and to establish direction for a Tree Protection Plan to address the potential im acts resulting from project developm nt on other Tow -protected onsite and offsite trees that are slated for retention. 1. —cessity. The prim ry reason for rem val of the 37 trees, including seven Tow - protected trees, is that preservation of those trees w uld be inconsistent w th the proposed residential developm nt of the property, including the creation of a new roadw y to access the m in project area. 2. rosion/surface w ter flow Rem val of the 37 trees, including seven Tow - protected trees, w uld not cause significant soil erosion or cause a significant diversion or increase in the flow of surface w ter. 3. isual effects. In addition, the applicant w 11 be required to replace all Tow -protected trees to be rem ved w th approved species "of a cum lative num er and diam ter necessary to equal the diarn ter of the tree(s) w ich are approved for rem val" in accordance w th the Tow 's Tree Preservation 0 dinance. 4. em val of the 37 trees, including seven Tow -protected trees, w uld not significantly affect off-site shade or adversely affect privacy betw en properties due to the site's topography, the other trees that w uld rem in, and the locations of the trees in relation to other properties. State D nsity Bonus Law Pursuant to the State D nsity Bonus law (i.e., G vernm nt Code Section 65915), the applicant is entitled to w fivers of developm nt standards if application of those standards uld ave he ffect f hysically recluding he onstruction f development at the density perm tted by the statute. The Tow m y refuse any such requested w iver if there is substantial evidence that such a w iver w uld have specific, adverse impact upon the health or safety of the com nity or the physical environm nt. The applicant has not requested any w fivers of developm nt standards as part of their request for a density bonus. Clear signage stating these operation standards shall be provided by the applicant for construction workers at all project access points. 8. (AR Q ITY M CO Prior to construction activity, construction equipm nt shall be checked by a certified visible em ssions evaluator. All construction equipm nt shall be m intained and properly tuned in accordance with m nufacturer specifications. 9. (N SE M CO Prior to any construction work on the site, including grading, the applicant shall install a m nim m 3' x 3' sign at the project entry which specifies the allowable construction work days and hours, and lists the nam and contact person for the overall project m eager and all contractors and sub- contractors working on the job. Construction activity shall be restricted to the period between the weekday hours of 7:30 a.m to 5:30 p.m (M nday through Friday), unless otherwise approved in writing by the City Engineer for general construction activity and the Chief Building Oficial for building construction activity. 0. N SE M CO The applicant shall require contractors and subcontractors to fit internal com ustion engines with m fflers and to locate stationary noise - generating equipm nt as far away from existing residences as feasible. 1. N SE M CO Construction Equipm nt M fflers and M intenance. All internal com ustion engine -driven equipm nt utilized on the project site and all stationary noise sources shall be equipped with intake and exhaust m fflers that are m intained in good condition and are equipm nt-specific accordance with the m nufacturers' recom ndations for the respective equipm nt utilized. Construction traffic to and from the construction sites shall be routed as directed by the City Engineer and the Transportation M nager of the D nville D velopm nt Services D partm nt. Construction -related heavy truck traffic is prohibited from traveling through residential areas and shall be routed onto m jor roadways and as far from sensitive receptors as feasible. 5. N SE M CO Q iet Equipm nt Selection. To the extent feasible, the project shall m ke se f uiet construction equipm nt, particularly it com ressors. Air com ressors and pneum tic equipm nt shall be equipped with m fflers, and im act tools shall be equipped with shrouds or shields. [N te: "Q iet construction equipm nt" is considered to be equipm nt that typically generates noise levels 5 dBA lower than that of com arable equipm nt.] 6. N SE M CO N ise Construction Liaison. A noise construction liaison shall be designated by the applicant to ensure coordination between construction staff and property owners and residential and com rcial tenants within 350 foot radius from the external boundaries of the project site. These property owners and tenants shall be notified in writing of the contact inform tion for the construction liaison a m nim m of 15 days prior to the initiation of construction or pre - construction activity. 7. N SE M CO Exterior -to -Interior N ise M tigation. Exterior building assem lies shall be sound -rated as deem d necessary by the project acoustical engineer to reduce transportation noise to the CN L 45 dB interior noise goal set forth in the D nville 2030 General Plan for residential uses. Sound -rating assem lies for windows and exterior doors shall be as called for in Figure 2 of the project's Environm ntal N ise Assessm nt, unless otherwise dictated by the project acoustical engineer at the tim of subm ttal for building perm ts. Sound insulations ratings shall be for the com lete window and door assem ly, including glass and fram , as based on laboratory test reports of sim lar sized sam les from an N LAP accredited lab. W ndows and exterior doors shall be assem led with sound insulation ratings of up to Sound Transm ssion Class (STC) 37, as applicable. To reduce the im acts of traffic noise to approxim telt' CN L 65 dB from Cam no Tassajara and Sherburne H Us Road to the backyard areas for proposed Lots 1, 11 and 12, the project precast concrete wall to be placed at the Cam no Ram n property lines for these three lots and at the Sherburne H lls Road property line for Lot 1 shall be constructed with a residence -side wall height of seven feet. To reduce the im acts of traffic noise to approxim telt' 60 dB from Sherburne H lls Road to the backyards of proposed Lots 2 and 3, the proposed precast concrete wall to be placed at the Sherburne H lls Road property line for these two lots shall be constructed with a residence -side wall height of seven feet. 9. CU TU A RESO CES M CO In response to the project com nts dated Septem er 24, 2018 from the N rthwest Inform tion Center Sonom State U iversity regarding the project's potential to adversely affect cultural (i.e., archaeological, native Am riean, and/or built environm nt considerations), the applicant shall arrange for a qualified archaeologist to conduct archival and field study of the project site, supplem ming the previous study (Porter 1980) that covered approxim telt' 10% of the proposed project area to identify cultural resources that m y be present at the project site. The construction staging plan shall indicate that construction vehicle access to Cam no Tassajara shall be lim ted to access from the property's frontage along Sherburne H Us Road and/or from the existing drivew y connection to Cam no Tassajara located at the northeast corner of the property. 6. he applicant shall w rk w th the Tow to prepare an affordable housing agreem nt (A reem nt) for the project, addressing the developm nt, retention, and tenant occupancy of the eight attached for rent below in rket rate accessory dw Ming units (BM A ) to be provided in the project as a result of the project's approved density bonus. The A reem nt shall be consistent w th the applicable provisions of the state density bonus law (G vernm nt Code Section 65915) and the Tow 's density bonus ordinance (M nicipal Code Section 32-74). Where rented during the term of the A reem nt, the BM A shall be rented at an affordable rate, as set by the California D partm nt of H using and Com nity D velopment to be affordable to low incom households. Prior to approval of the Final M p A reem nt shall be subject to review and approval by the Tow Council prior to recordation of the Final M p for the project. The notice shall include a list of contact persons w th nam , title, phone num er and area of responsibility. The person responsible for m intaining the list shall be included. The list shall be kept current at all tim s and shall consist of persons w th authority to initiate corrective action in their area of responsibility. The nam s of individuals responsible for dust, noise and litter control shall be expressly identified in the notice. 7. The nesting survey shall include exam nation of all trees within 200 feet of the area proposed for dem lition or construction activity. If birds are identified nesting on or within the zone of proposed dem lition or construction activity, a qualified biologist shall establish a tem orary protective nest buffer around the nest(s). W ere protective nest buffering is deem d necessary, the nest buffer(s) shall be staked with orange construction fencing or orange lath staking. The buffer shall be of sufficient size to protect the nesting site from dem lition or construction related disturbance and shall be established by a qualified ornithologist or biologist with extensive experience working with nesting birds near construction sites. Typically, adequate nesting buffers are 50 feet from the nest site or nest tree dripline for sm ll birds, and up to 250 feet for sensitive nesting birds that include several raptor species known in the region of the project site. These include, but are not lim ted to, changes to project dem lition plans, site plans, project im rovem nt plans, utility and drainage plans, grading plans, and landscape and irrigation plans. b. he vertical and horizontal locations of the Town -protected trees that are slated for retention, whether onsite trees or offsite trees, with at least 15% of their tree dripline extending into the project site, shall be established and plotted on all plans. O ce trunk locations for such trees are plotted on plans, they shall be reviewed by the Consulting Arborist who shall have the responsibility to assess potential im acts to individual trees and to establish tree protection zones for such trees. In onstruction trailers, traffic and storage areas shall rem in outside of identified tree protection zones areas at all tim s. n. rior to grading, pad preparation, excavation for foundations, footings, walls, or trenching, trees requiring root pruning outside the tree protection zone shall be done by cutting all roots cleanly to the depth of the excavation. Roots shall be cut by m nually digging a trench and cutting exposed roots with a saw, vibrating knife, rock saw, or other approved root pruning equipm nt. The Consulting Arborist shall identify where root pruning is required and m nitor all root pruning. Prior to the issuance of grading or building perm ts, a security deposit in the am unt of the assessed value of the tree(s) (calculated pursuant to the Town's Tree Protection O dinance) shall be posted with the Town to m xim ze the probability that the affected trees will be retained in good health. The applicant shall be required to secure an appraisal of the condition and value of all affected trees. The appraisal shall be done in accordance with the current edition of the "Guide for Establishing Values of Trees and O her Plants," by the Council of Tree and Landscape Appraisers under the auspices of the International Society of Arboriculture. The appraisal shall be perform d by a Certified Arborist, and shall be subject to review and approval by the Chief of Planning. A tree preservation agreem nt shall be prepared that outlines the intended and allowed use of funds posted as a tree preservation security deposit. That portion of the security deposit still held by the Town two full growing seasons after project com letion shall be returned upon verification that the trees covered by the deposit are as healthy as can be provided for under the term of the tree preservation agreem nt. q. ocused applicant attention shall be given to m nim zing adverse project im acts to the existing offsite Redwood trees lying to the west of Lot 1 that are located in the side yard area of 327 M ntoya W y. 4. (BIO O CA RESO CES M CO To com ensate for the proposed rem val of identified Town -protected trees, the applicant shall assure the im lem ntation of the following m asures: a. he applicant's Consulting Arborist shall calculate the total inches of diam ter of Town -protected trees to be rem ved, as of the date of the grading perm t application (i.e., the "Total Inches"), and subm t that calculation to the Planning D vision of the D nville D velopm nt Services D partm nt. The applicant shall be required to replace the identified Town -protected trees to be rem ved with a num er and size of oak trees equal to the total inches of the diam ter of the trees to be rem ved. The required tree m tigation planting m y be part of the project's landscape plan. b. t is currently estim ted that all m tigation oak trees cannot be accom dated onsite. O site m tigation trees shall be either 15 -gallon size trees (credited at a ratio of 2" per tree toward the aggregate replacem nt planting) or 24 -inch box size trees (credited at a ratio of 4" per tree toward PA 22 0 RESO U IO N 31-2019 DocuSign Envelope ID: 34331802-5C7C-47E2-AADC-B8AFAF6CBBDC the aggregate replacem nt planting). Tree m tigation planting that cannot be accom dated onsite shall be handled through the applicant's paym nt Of an in -lieu fee, which shall be m de payable to the Town of D nville. This in -lieu fee shall be in the am unt of $135.00 per off-site m tigation tree. This m tigation fee is based on a $135.00 installed cost per 15 -gallon tree indicated in recently approved Town -sponsored capital im rovem nt projects. The in -lieu m tigation funds received by the Town will be applied to an account chosen by the Town for use by the D nville M intenance D partm nt staff to allow the purchase and planting of beautification trees within the Town of D nville. A y grading on adjacent properties w uld require prior w itten approval of those property ow ers affected. Consistent with FC D strict recom ndations, the project is required to m tigate its potential adverse drainage im acts upon the San Ram n Creek watershed. Toward that end, the applicant shall m tigate the im act of adding storm ater runoff into the San Ram n Creek watershed by either of the following m thods: a. em ve 1 cubic yard of channel excavation m terial from the inadequate portion of San Ram n Creek for each 50 square feet of new impervious surface area created by the developm nt. All excavated m terial shall be disposed of off-site by the applicant at his own cost. The applicant shall supply a worksheet to the FC D strict, which includes a scalable m p that shows the square footage of the existing and proposed im ervious areas. 18. H D O O A WATER Q ITY M CO W en sites are developed, debris from construction or dem lition activity shall go to a solid waste and/or recycling facility that com lies with the applicable requirem nts and can lawfully accept the m terial (e.g., solid waste perm t, EA N tification, etc.). The debris shall be transported by a hauler that can lawfully transport the m terial. D bris bins or boxes of one cubic yard or m re owned by the collection service operator shall be identified with the nam and telephone num er of the agent servicing the container. 19. U ILITIES A SERVICE SYSTEM M CO The proposed project shall conform to the Town's Storm ater M nagem nt and D seharge Control O dinance (O d. N . 2004-06) and all applicable construction Best M nagem nt Practices (BM s) for the site. For exam le, construction BM s m y include, but are not lim ted to: the storage and handling of construction m terials, street cleaning, proper disposal of wastes and debris, painting, concrete operations, v dewatering perations, avem nt perations, ehicl%quipm nt cleaning, m intenance and fueling and stabilization of construction entrances. Training of contractors on BM s for construction activities is a requirem nt of this perm t. At the discretion of the D nville D velopm nt Services D partm nt, a Storm W ter Pollution Prevention Plan (SW PP) m y be required for projects under five acres. 20. U ILITIES A SERVICE SYSTEM M CO All grading activity shall address N tional Pollutant D scharge Elim nation System (N D S) concerns. U ILITIES A SERVICE SYSTEM M CO Prior to approval of the Final M p, the applicant shall prepare and subm t a detailed O eration and M intenance Agreem nt to the D velopm nt and Services D partm nt for review and approval. The O enation and M intenance Agreem nt shall identify the m intenance and funding for proposed storm water m nagem nt features at the project site (i.e., bio -retention facility, storm water detention basin). All features shall be m intained and funded by the local hom owners' association (H ), GH D or other instrum nt determ ned to be acceptable to the Town. The m intenance protocols shall address both routine and non -routine m intenance activities and shall explicitly identify m nitoring and reporting requirem nts. These protocols shall include an estim to of annual m nitoring and m intenance costs. 6. EN RG M CO In order to ensure that energy dem nd is reduced to avoid the wasteful or inefficient use of energy, the applicant shall subm t detailed design - level plans to the Town of D nville identifying that energy conservation m asures have been incorporated into design and operation of the project, prior to the issuance of any building perm t.
