APPROVTNG DEVELOPMENT PLAN REQUEST DEV1.8-0004
ALLOWING EXTERIOR FAçADE IMPROVEMENTS FOR THE EXISTING
MEDICAL OFFICE BUILDING LOCATED AT 4OO EL CERRO BOULEVARD
(APN: 200-1.40-016)
WHEREAS, NEARON (Owner) and HABITEC ARCHITECTS (Applicant) have
requested approval of a Development Plan request (DEV18-0004) to allow exterior façade
improvements for the existing medical office building; and
WHEREAS, the subject site is located at 400 El Cerro Boulevard and is further identified
as Assessor's Parcel Number 200-140-016; and
WHEREAS, the O-1: Comrnercialf Limited Office zoning district requires approval of a
Development Plan application prior to the construction of exterior modifications for a
commercial office building; and
WHEREAS, the project has been found to be Categorically Exempt from the requirements
of the California Environmental Quality Act (CEQA), Section 15301-, Class 1" because the
proposed modifications to the existing building does not propose any unusual
characteristics resulting in any significant impacts relating to traffic, noise, air quality, or
water quality.; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing
on May 8,2018; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Planning Commission
approve the requesü and
WHEREAS, the Planning Commission did hear and consider all reports,
recoÍunendations, and testimony submitted in writing and presented at the hearing;
now therefore, be it
RESOLVED, that the Danville Planning Commission of the Town of Danville approves
Development Plan request DEV18-0004 per the conditions contained hereiry and makes
the following findings in support of this action:

FINDINGS OF APPROVAL FOR DEVELOPMENT PLAN:
The applicant intends to obtain permits for construction within eighteen (18)
months from the effective date of plan approval.
2. The Development Plan is consistent with the Danville 2030 General Plan.
The development will be attractive and efficient, and will fit harmoniously into
and have no adverse effects upon the adjacent or surrounding development.
CONDITIONS OF APPROVAL
Conditions of approval with an asterisk ç"*") inthe left-hand column are standard project
conditions of approval.
Unless otherwise specified, the following conditions shall be complied with prior to the
issuance of a building permit for the project. Each item is subject to review and approval
by the Planning Division unless otherwise specified.
Except as may be modified by the conditions contained herein,
development shall be substantially as shown on the plans labeled "Exterior
and Site Upgrades 400 El Cerro Boulevard," consisting of 10 sheets, as
prepared by Habitec Architecture, dated received by the Planning Division
on April 4, 2018 and landscape plans labeled "Landscape and Plant
Images," consisting of 4 sheets, as prepared by Habitec Architecture, dated
received by the Planning Division on April 13,2018.
The applicant shall pay arry and all Town and other related fees that the
property may be subject to. These fees shall be based on the current fee
schedule in effect at the time the relevant permits aÍe secured, and shall be
paid prior to issuance of said permit. The applicant shall reimburse the
Town for notifying surrounding neighboring residents of the proposed
development request and one public hearing. The fee shall be fi361'.26 (2
mailings x ($130.00 plus 61 notices X $0.83 per notice)).
Construction activity shall be restricted to the period between the weekday
hours of7:30 a.m. to 5:30 p.m. (Mondays throughFridays), unless otherwise
approved in writing by the City Engineer for general construction activity
and the Chief Building Official for building construction activity.

The project shall be constructed as approved. Minor modifications may be
approved by staff. As determined by the Chief of Planning, modifications
may require approval through a separate Development Plan review
pfocess.
The applicant shall obtain a building permit from the Town Building
Division prior to the coffunencement of any construction work.
At any time during the effectiveness of this approval, the approval shall be
revocable for cause in accordance with sections 30-4.11, and 30-4.1"5 of the
Danville Municipal Code, including failure to comply with these conditions
of approval if the applicant has caused or permitted any public nuisance in
connection with the use.
