HomeMy WebLinkAbout033-2018RESOLUTION NO. 33-2018 APPROPRIATING ADDITIONAL FUNDING AND AWARDING A CONSTRUCTION CONTRACT FOR THE VISTA GRANDE/BRET HARTE PEDESTRIAN IMPROVEMENT PROJECT, CIP NO. B-574 WHEREAS, the Danville Town Council previously appropriated funding for the Vista Grande/ Bret Harte Pedestrian Improvement Project, CIP No. B-574, in the adopted 2016/17 Capital Improvement Program; and WHEREAS, the funding includes federal grant funds from Contra Costa share of Cycle 2 Congestion Mitigation and Air Quality (CMAQ) SR2S which is administered by Caltrans; and WHEREAS, the funding requires an 11.47 percent local funding match; and WHEREAS, Caltrans, acting on behalf of the Town, has determined that the project is Categorically Excluded from requirements of the National Environmental Policy Act (NEPA); and WHEREAS, the plans and specifications for the proposed work have been reviewed and approved by the City Engineer; and WHEREAS, the Danville City Clerk or its designee of this Town did, in open session on the 8th day of March, 2018, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the lowest responsive bidder is California Highway Construction of Concord, California, with a bid of $162,200 and the City Engineer has recommended awarding a construction contract for the project to said contractor; and WHEREAS, funding has been appropriated in Contract No. B-574 of the adopted Capital Improvement Program for the project, yet an additional appropriation is needed to award the construction contract and authorize a construction contingency; now, therefore, be it RESOLVED, by the Danville Town Council, that $22,249 in Park Dedication Impact Fees be appropriated in fiscal year 2017/18 for CIP No. B-574 to fund construction of the project; and, be it further RESOLVED, by the Danville Town Council, that the Town award the construction contract for Vista Grande/ Bret Harte Pedestrian Improvement Project, CIP No. B-574 to California Highway Construction of Concord, California; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute, on behalf of the Town, a written contract with California Highway Construction of Concord, California for $162,200 and authorize use of a 20% contingency amount of $32,440 for a total construction budget of $194,640 for work in connection therewith, and the Danville City Clerk or its designee is hereby directed to attest same and affix thereto the official seal of the Town; and, be it further RESOLVED, that the Town shall within five (5) days of the adoption of this resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings.)
