HomeMy WebLinkAbout022-2018RESOLUTION NO. 22-2018 APPROVING GENERAL PLAN AMENDMENT REQUEST LEG17-03; AMENDING THE DEFINITION OF NET DENSITY FOR AREAS DESIGNATED AS RESIDENTIAL SINGLE FAMILY LOW DENSITY (1 TO 3 UNITS PER ACRE) AND RESIDENTIAL SINGLE FAMILY MEDIUM DENSITY (3 TO 5 UNITS PER ACRE) UNDER THE 2030 GENERAL PLAN (Various Property Owners) WHEREAS, the Danville 2030 General Plan (2030 Plan), as adopted on March 19, 2013, provides, in part, direction on the Town's development review process and its long-range planning activities, with the goals, policies, and implementation measures contained in the 2030 Plan guiding the decision-making related to those functions; and WHEREAS, the 2030 General Plan includes language which indicates that the density range calculation for all residential development would be based upon "net" acreage and that the net acreage excludes street rights-of-way, utility easements, and drainage channels; and WHEREAS, this methodology can be problematic when applied to the Residential Single Family Low Density (1 to 3 units per acre) and the Residential Single Family Medium Density (3 to 5 units per acre) land use designations given that public street rights-of-way are generally required to serve new homes at these density ranges; and WHEREAS, LEG17-03 (GPA) would amend applicable text of the 2030 General Plan to allow all lands designated as Residential Single Family Low Density (1 to 3 units per acre) and Residential Single Family Medium Density (3 to 5 units per acre) to utilize a net density calculation which does not require the exclusion of street rights-of-way, utility easements, and drainage channels; and WHEREAS, the Town Council finds that LEG17-03 is categorically exempt from CEQA under CEQA Guideline Section 15061(b)(3) as the evidence in the record shows that the EIR certified for the adoption of the 2030 General Plan and the environmental work prepared for adoption of the 2014-2022 Danville Housing Element assumed that that the Town was calculating maximum density for single family designations using gross rather than net acreage; and WHEREAS, any potential environmental impacts have already been studied and analyzed in those documents; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on November 14, 2017 and recommended the Town Council approve LEG17-03; and WHEREAS, the Town Council held a public hearing to consider all reports, recommendations; and testimony submitted in writing and presented at the hearing, and WHEREAS, public notice of the actions, by both the Planning Commission and the Town Council, was given in all respects as required by law; now, therefore, be it RESOLVED that the Danville Town Council approves General Plan Amendment request LEG17-03 to make the following changes to the text of the 2030 General Plan: • Page 3-32 - Amend paragraph two under "Residential Areas" to read as follows: Densities on the Land Use map range from Rural Residential to Multifamily High. Densities are expressed as the number of dwelling units per "net" acre of land (this is referred to as "net density"). For all residential land use designations except the Residential Single Family Low Density (1 to 3 units per acre) and the Residential Single Family. Medium Density (3 to 5 units per acre) land use designations, net Net acreage shall excludes -street rights -of -ways For all residential land use designations, net acreage shall exclude, utility easements, drainage channels; and similar areas that cannot be developed. For all of the residential land use designations, net Net acreage shall also exclude areas which are undevelopable due to environmental constraints. For any individual parcel of land, the maximum allowable development density shall be determined after accounting for land which is undevelopable due to geologic, topographic, and natural features (e.g., creeks, floodplains, etc.), along with r ^r=m etef and interior- stye If the project requires subdivision, very steep slopes may also be • Page A-2 of the Glossary of Terms - Amend the definition to read as follows: Acres (Net) The portion of a site that is available with no constraints to be built upon. The following generally are not included in net acreage of a site: area required for street rights-of-way, lands which are undevelopable due to geologic, topographic, and natural factors (e.g., drainage channels, creeks, flood plains, etc.). If the project requires subdivision, very steep slopes may also be excluded.
