A RESOLUTION OF THE ÐANVILLE PLANNING COMMTSSION
RECOMMENDING THE DANVILLE TOWN COUNCIL APPROVE
GENERAL PLAN AMENDMENT REQUEST LEG1.7.O3 (GPA)
(Various Property Owners)
SECTION 1.. LEGISLATIVE INTENT
WHEREAS, the Danville 2030 General Plan (2030 Plan), as adopted on Marc}l.1g,2013,
provides, in parf direction on the Town's development review process and its long-range
planning activities, with the goals, policies, and implementation measures contained in
the 2030 Plan guiding the decision-making related to those functions; and
WHEREAS, the 2030 General Plan includes language which indicates that the density
range calculation for all residential development would be based upon "rret" acreage and
that the net acreage excludes street right-of-way, utility easements, and drainage
channels; and
WHEREAS, the use of net acreage for the density calculation for multifamily sites,
including the exclusion of street right-of-way, utility easements, and drainage channels,
is appropriate given that those sites typically do not utilize internal public streets and
rights-of-way; and
WHEREAS, this methodology can be problematic when applied to the Residential -
Single Family - Low Density (L-3 units per acre) and the Residential - Single Family -
Medium Density (3 -5 units per acre) land use designations given that public street rights-
of-way that are generally be required to serve new homes at these density ranges; and
WHEREAS, the estimated potential additional residential units that could occur as a
result of the proposed change are not above and beyond the potential units previously
assumed in the Environmental Impact Report (EIR) prepared in conjunction with the
review and adoption of the Danville 2030 General Plan as well for the environmental
documents prepared in conjunction with the review and adoption of the DanvilIe 20'J,4-
2022Housing Elemenf now therefore be it
WHEREAS,LEG1T-O3 (GPA) would amend applicable text of the 2030 General Plan to
allow all lands designated as Residential - Single Family - Low Density (1-3 units per acre)
and Residential - Single Family - Medium Density (3 -5 units per acre) to utilize a net
density calculation which does not require the exclusion of street right-of-ways, utility
easements, and drainage channels; and

WHEREAS, the Planning Commission did hear and consider all reports,
recotrunendations, and testimony submitted in writing and presented at the hearing;
now therefore, be it
RESOTVED that the Planning Commission of the Town of Danville recommends that
the Town Council approve General Plan Amendment request LEG17-03 (GPA) to make
the following changes to the text of the 2030 General Plan:
Amend the second paragraph under the heading "Residential Areas" on Page 3-32 ol
Danville 2030 General Plan to read as follows
"Densities on the Land Use map range from Rural Residential to Multifamily High.
Densities are expressed as the number of dwelling units per "net" acre of land (this is
referred to as "net density"). For all residential land use designations except the
to 3 units acfe and the Residential -
- Medium Densi to 5 units acfe land use net Ne*
acreage shall excludes street rights-of-wayy For all residential
net shall exclu drainage channelsT and similar areas that
cannot be developed. For all of the residential land use designations, net Net acreage
shall also excludes areas which are undevelopable due to environmental constraints.
For any individual parcel of land, the maximum allowable development density shall
be determined after accounting for land which is undevelopable due to geologic,
topographic,andnatura1features(e.g.,creeks,f1oodp1ains,etc.)@

Amend the definitionfor Acres (Net) onPage A-2 of the Glossary of Terms of the Danville
2030 General Plan to read as follows:
Acres (Net)
"The portion of a site that is available with no constraints to be built upon. The
following generally are not included in net acreage of a site: area required for street
rights-of-way, lands which are undevelopable due to geologic, topographic, and
natural factors (e.g., drainage channels, creeks, flood plains, etc.). If the project
requires subdivisiorL very steep slopes may also be excluded.
RESOLVED that the Planning Commission of the Town of Danville recoÍunends that
the Town Council approve General Plan Amendment request LEGI7-03 (GPA):
