HomeMy WebLinkAbout2017-12RESOLUTION NO. 2017-L2 RECOMMENDING THAT THE TOWN COUNCIL APPROVE ZONING TEXT AMENDMENT 2TA1.6.0110 AMENDING THE DOWNTOWN BUSINESS DISTRICT ORDINANCE WHEREAS, The Town of Danville has initiated a Zoning Text Amendment 2TA1,6- 0110 to amend Section 32-45 of the Danville Municipal Code related to the Downtown Business Districü and WHEREAS, the Downtown Business District Ordinance would apply to the Downtown Master Plan area identified within the Danville 2030 General Plan; and WHEREAS, the Zoning Text Amendment as presented to the Planning Commission would amend portions of the Downtown Business District Ordinance to update use definitions, allowable uses, regulatory processes, and the time to re-establish legal non- conforming uses from 90 days to 30 days; and WHEREAS, the Planning Commission recoûunended that the time to re-establish legal non-conforming uses from 90 days to 60 days; and WHEREAS, the Zoning Text Amendment is not considered a project under the California Environmental Quality Act (CEQA) as the Zoning Text Amendment does not have the potential to result in either a direct physical change in the environment or a reasonably foreseeable,indirect physical change in the environment, and therefore, is not subject to the requirements of CEQA; and WHEREAS, the Planning Commission did review the Zoning Text Amendment request at a noticed public hearing on September 12,2017; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, the Planning Commission did hear and consider all reports, reconunendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Planning Commission of the Town of Danville recommends that the Town Council approve ZoningText Amendment 2TA1Á-0110 amending the Town's Downiown Business District Ordinance.
