HomeMy WebLinkAbout2017-02RESOLUTION NO. 2077-02 RECOMMENDING THAT THE TOWN COUNCIL APPROVE ZONING TEXT AMENDMENT ZTA17.OOO1 AMENDING THE TOWN'S SECOND DWELLING UNIT ORDINANCE WHEREAS, The Town of Danville has initiated a Zorrtng Text Amendment ZTA17- 0001 to amend Section 32-76 of the Danville Municipal Code related to Second Dwelling Units; and WHEREAS, the Accessory Dwelling Unit Ordinance (formerly Second Dwelling Unit) would apply to residential lands identified within the Danvitle 2030 General Plan; and WHEREAS, the Accessory Dwelling Unit Ordinance would establish the purpose, Town review process, and design and development standards for accessory dwelling units developed in Town; and WHEREAS, all occuffences of the term Second Dwelling Unit in the ordinance and all references therein be replaced to Accessory Dwelling Unit to be consistent with state law; and WHEREAS, the Accessory Dwelling Unit Ordinance would establish parking requirements consistent with provisions of Section 65852.2 of the Government Code; and WHEREAS, the Accessory Dwelling Unit Ordinance would establish development standards for existing detached garages converted to accessory dwelling units; and WHEREAS, the Planning Commission did review the Zoning Text Amendment request at a noticed public hearing on March 1.4,2017; and WHEREAS, the Zoning Text Amendment is statutorily exempt from CEQA and no significant environmental impacts are expected to be associated with the adoption of this ordinance; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that the Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recorrunendations, and testimony submitted in writing and presented at the hearing; no4 therefore, be it RESOLVED that the Planning Commission of the Town of Danville recornmends that the Town Council approve ZoningText Amendment ZTA17-0001 amending the Town's Second Dwelling Unit Ordinance. APPROVED by the Danville Planning Commission at a regular meeting on March1.4, 2017 by the following vote: AYES: NOES: ABSTAIN: ABSENT: Bowles, Combs, Graham, Haberl, Heusler, Radich Verriere Chairman APPROVED AS TO FORM: City Attorney Chief PAGE 2 OF'RESOLUTION NO. 2017-02 None None
