HomeMy WebLinkAbout2017-07RESOLUTION NO. 2OI7-07 APPROVING A ONE.YEAR TIME EXTENSION OF A PREVIOUSLY APPROVED MrNOR SUBDTVTSTON REQUEST MS 856-20L3 AT 74081PINTADO ROAD ALLOWTNG A TWO PARCEL SUBDIVISION OF A 4.44+/- ACRE SITE (APN: 197--t61-070 - ARCHER) WHEREAS, Steve & Jody Archer have requested approval of a one-year time extension of a previously approved Minor Subdivision request MS 856-20L3 to subdivide an existing 4.44 + / - acre parcel into two single family residential parcels, resulting in one additional parcel; and WHEREAS, the subject property is located at 740 El Pintado Road and is further identified as Assessor's Parcel Number 197-1'6'1"-070; and WHEREAS, the Town of Danville Subdivision Ordinance allows for extensions of a previously approved parcel map for a maximum time period of 24 months; and WHEREAS, the subject extension request constitutes the first L2-month extensiory extending the valid time period for the approval until October 28,2018; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on ]une 27,2017; and WHEREAS, the project has been found to be Ministerially Exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a sl'aff. report was submitted recommending that the Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now therefore, be it RESOLVED, that the Planning Commission of the Town of Danville approves a one- year time extension of MS 856-2013, and makes the following findings in support of this action: 1, 2 The proposed project is consistent with the Danville 2030 General Plan. The uses authorized and the subdivision of land are consistent with the requirements of the subject R-65; Single Family Residential District. Conditions within the neighborhood are substantially the same as the conditions under which the project was originally approved. 4. The exercise of the previously approved Minor Subdivision will not result in an adverse impact the health, safety, or welfare of the Town.
