HomeMy WebLinkAbout2017-08RESOLUTION NO. 2017.08 AppRovAL oF DEVELOPMENT PLAN REQUEST DEVL7-0008 TO ALLOW THE CONSTRUCTION OF A 518 +/- SQUARE FOOT OPEN AIR PAVILION WITH A 130 +/- SQUARE FOOT BATHROOM AND STORAGE AREA ON A PARCEL LOCATED WITHIN A TOIAN\-IDENTIFIED MAIOR RIDGELINE AREA (APN: 207-081-033 - ARORA) WHEREAS, WILLIAM WOOD ARCHITECTS (Applicant) and PRITINDER S. & MANINDER ARORA (Owner) have requested approval of a Development Plan request (DEV17-0008) to allow the construction of a 518 + f - square foot open air pavilion with a 130 + ¡ - square foot bathroom and storage area on a9.12 acre parcel; and WHEREAS, the subject property is located at L351 Dutch Mill Drive, and is further identified as Accessor's Parcel Number 207-081.033; and WHEREAS, the Town of Danville's Major Ridgeline and Scenic Hillside Development Ordinance requires approval of a Development Plan application prior to development within a Town-identified Major Ridgeline area; and WHEREAS, the project has been found to be Categorically Exempt from the Requirements of the California Environmental Quality Act (CEQA), Section 1"5303, Class 3; and WHEREAS, the proposed development is located within l-00 vertical feet of the top of the ridgeline, therefore an exception to the Town's Scenic Hillside and Major Ridgeline ordinance is required; and WHEREAS, a staff report was submitted recommending that the Planning Commission approve this request; and WHEREAS, the Planning Commission did review the project at a noticed public hearing onJune 27,2017; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now therefore, be it RESOLVED that the Danville Planning Commission approves Development Plan request DEV17-0008 per the conclitions of approval contained herein; and makes the following findings in support of this action: FINDINGS OF APPROVAL Development Plan 1". The proposed project is consistent with the Town of Danville's 2030 General Plan. The proposal meets the design and development standards listed within the Town's Single Family Residential Zoníng Ordinance. 2. Development Plan and architecture of the structure will not conflict with the intent and purposes of Ordinance 29-84 ("Scenic Hillside and Major Ridgeline Development"), in that development will be achieved with minimal grading and will not adversely impact predominate views of a Town-identified Scenic Hillside or Major Ridgeline area. 3. The proposed development is in conformance with the goals and policies of the 2030 General Plan. 4. The proposed development is in substantial conformance with the zoning district in which the property is located. The proposed addition will be consistent with the structure setback and maximum structure height applicable to this property as set forth by the P-l-; Planned Unit Development District' 5. The development will be an attractive and efficient development which will fit harmoniously into and will have no adverse effects upon the adjacent or surrounding development. Exception to Permit Development Within 100 Feet of Major Ridgeline 1". Due to the application of this sectiory a suitable structure could not otherwise be constructed on the parcel. Development is designed to take place as far beneath the centerline of the major ridgeline as practical. The proposed siting, grading, landscaping and architecture are such that the development will not conflict with the purposes set forth in subsection32-69.1'.b. of the Scenic Hillside and Major Ridgeline Ordinance. 2. .-l PAGE 2 OF RESOLUTION NO. 2017.08 CONDITIONS OF APPROVAL t. This approval is for Development Plan request DEV17-0008, authorizing the construction of a 5L8 + f - square foot open air pavilion with a l30 + f - sqtate foot bathroom and storage area on a 9.12 acre parcel. Except as may be modified by these conditions of approval, development shall be as shown on the project plans labeled " AÍora Pavilion - 1351 Dutch Mill Drive," consisting of 9 sheets, dated received by the Planning Division on June 7,2017. 2. The applicant shall pay or be subject to any and all Town and other related fees that thè property may be subject to. These fees shall be based on the current fee sched.ule in effect at the time the relevant permits are secured, and shall be paid prior to issuance of said permit. 3. Construction activity shall be restricted to the period between the weekday hours ,of 7:30 a.m. to 5:30 p.m. (Monday through Friday), unless otherwise approved in writing by the City Engineer for general construction activity and the Chief Buitding Official for building construction activity' 4. All building materials shall be delivered directly to the job site and shall not be allowed to be staged on Dutch Mill Drive. 5. Prior to the issuance of a buitding permit, the applicant shall reimburse the Town for costs incurred to notify neighboring residents of the proposed development plan request. Reimbursement shall be in the amount of fi174.82 ($130.00 plus 54 notices X $0.83 per notice) made payable to the Town of Danville.
