HomeMy WebLinkAbout2017-06RESOLUTION NO. 2077-06 AppRovING DEVELOPMENT PLAN REQUEST DEV17-0012 ALLOWING FOR THE CONSTRUCTTON OF ^196 +/, SQUARE FOOT LIVING AREA ADDITION AND A632+/- SQUARE FOOT GARAGE ADDITION TO THE EXISTING PRIMARY RESIDENCE ON A SITE LOCATED WITHIN A TOWN.IDENTIFIED MAIOR RIDGELINE AREA AT 14OO DUTCH MILL DRIVE (APN: 207-081-036 - MASON) WHEREAS, Chris and Jerri Mason (OWNER/APPLICANT) have requested approval of a Development Plan request (DEVL7-0012) to allow the construction of a196 +/- square foot living area addition and 632 + / - square foot garage addition to the existing primary residence onaI7.39 acre parcel; and WHEREAS, the subject property is located at L400 Dutch Mill Drive, APN: 207-081-036; and WHEREAS, the Town of Danville's Major Ridgeline and Scenic Hillside Development Ordinance requires approval of a Development Plan application prior to development within a Town-identified Major Ridgeline area; and WHEREAS, the project has been found to be Categorically Exempt from the Requirements of the California Environmental Quality Act (CEQA), Section 15303, Class 3; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on June 27,2017; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report.was submitted recommending that the Planning Commission approve this request; and WHEREAS, the Planning Commission did hear and consider all reports, reconunendations, and testimony submitted in writing and presented at the hearing; now therefore, be it RESOLVED that the Danville Planning Commission approves Development Plan request DEV17-0012 and.makes the following findings in support of this action: 1, FINDINGS OF APPROVAL: The proposed siting and architecture of the addition and garage addition will not conflict with the intent and requirements of the Major Ridgeline and Scenic Hillside Development Ordinance because development will be achieved with minimal grading and will not adversely impact predominate views of a Town- identified Major Ridgeline area. The proposed development is in conformance with the goals and policies of the panville 2030 General Plan because the development will be integrated in a manner that is compatible with the physical character of the surrounding community. The proposed development is in conformance with the zoning district in which the proþerff is located because the proposed additions will be established consisteñt with the structure setback and maximum structure heights set forth by the P-L; Planned Unit Development District applicable to this property. CONDITIONS OF APPROVAL: This approval is for Development Plan request DEVLT-0012, authorizing the construction of a196 +f - square foot living area addition and 632 +/- square garage addition to the existing primary residence on a 17.39 acre Parcel. Except ãr tr,uy be modified by these conditions of approval, development shall be as shown on the project plans labeled "The Mason Residence - 1400 Dutch Mill Drive," consisting of lL sheets, dated received by the Planning Division on June 1.,2017. The applicant shall pay or be subject to any and all Town and other related fees that tñe property mäy"be subject io. These-fees shall be based on the current fee schedule in effect at the time the relevant permits are secured, and shall be paid prior to issuance of said permit. Construction activity shall be restricted to the period between the weekday hours of 7:30 a.m. to 5:30 p.m. (Monday through Friday), unless otherwise approved in writing by the City Engineer for general construction activity and the Chief Buitding Official for building construction activity. All building materials shall be delivered directly to the job site and shall not be allowed to be staged on Dutch Mill Drive. 2. ıJ 1, J. 4 2 PAGE 2 OF RESOLUTION NO. 2O17.O6 5. Prior to the issuance of a building permit, the applicant shall reimburse the Town for costs incurred to notify neighboring residents of the proposed development plan request. Reimbursement shall be in the amount of fi212.17 ($130.00 plus 99 notices X $0.83 per notice) made payable to the Town of Danville.
