HomeMy WebLinkAbout2017-02ORDINANCE NO. 2017-02 AMENDING SECTION 17-22.2b OF THE TOWN OF DANVILLE MUNICIPAL CODE REAUTHORIZING THE PUBLIC, EDUCATIONAL AND GOVERNMENTAL FEE ON STATE VIDEO FRANCHISEES The Danville Town Council does ordain as follows: SECTION 1. AMENDING SECTION 17-22b OF THE TOWN OF DANVILLE MUNICIPAL CODE Section 17-22.2b of the Danville Municipal Code is hereby amended to read as follows: CHAPTER 17-22 STANDARDS FOR STATE VIDEO FRANCHISES Section 17-22.2 State Video Franchise and PEG Fees. (b) As authorized by Public Utilities Code Section 5870(n), any state video franchisee offering service within the Town shall pay to the Town a separate fee to support Public, Educational and Governmental ("PEG") channel facilities equal to sixty ($0.60) cents per month per subscriber. This PEG fee shall be automatically reauthorized at the same rate upon renewal of a state video franchise by the Public Utilities Commission. In addition, the expiration of one state franchise in the Town will not result in the expiration of the PEG fee if at least one other franchisee continues to provide video service in the Town subject to that fee. SECTION 2. PUBLICATION AND EFFECTIVE DATE. The City Clerk shall have this ordinance published in a newspaper of general circulation within 15 days after adoption. This ordinance shall become effective 30 days after adoption. SECTION 3. SEVERABILITY. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of the ordinance. The Danville Town Council hereby declares that they would have adopted the ordinance, and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases was declared invalid. The foregoing ordinance was introduced on March 7, 2017 and approved and adopted by the Danville Town Council at a regular meeting on March 21, 2017, by the following vote: AYES: NOES: Arnerich, Blackwell, Morgan, Stever.
