APPROVING THE DOWNTOWN PARKING IN LIEU FEE NEXUS STUDY,
ADOPTING THE PARKING IN LIEU FEE AND ADDING IT TO THE TOWN'S
MASTER FEE SCHEDULE
WHEREAS, in 1986 the Town adopted the Downtown Master Plan, establishing the
long term vision for development and uses of property in Downtown Danville; and
WHEREAS, in 1987 the Town's zoning ordinance established the Downtown Business
District (the "DBD"), which contains 12 different areas; and
WHEREAS, properties in Areas 1, 2, 2A, 3 and 11 of the DBD (the "Downtown Core")
are required to provide 25-50% of their required parking off site, in municipal parking
lots; and
WHEREAS, in order to help pay for the cost of providing municipal parking to serve
these areas of the DBD, in 1987 the Town adopted a parking in lieu fee. That fee (set at
$3,500 per space for retail uses and $7,000 per space for all other uses) has not been
increased since 1987 and has been used to help finance the construction of 700 public
parking spaces in the Railroad Avenue, Clocktower, Village Theater, Front Street and
Library/ Community Center parking lots; and
WHEREAS, in 2016, the Town prepared a Downtown Parking Utilization Assessment,
which determined that there is sufficient public parking available to meet current
development and uses; and
WHEREAS, in order to determine how many additional public parking spaces will be
required to serve remaining potential development in the Downtown Core, the cost of
providing such parking, and the need for an increase in the existing in lieu fee, the
Town Council directed preparation of a Parking In Lieu Fee Nexus Study (the "Study")
by the firm TJKM; and
WHEREAS, the Study was prepared to comply with the Mitigation Fee Act
(Government Code Section 66000 et seq.) and contains all required analysis; and
WHEREAS, notice of this public hearing was provided as required by the Mitigation
Fee Act and in addition was mailed to all potentially affected property owners in the
Downtown Core area; and
WHEREAS, the Town Council has reviewed and duly considered the Staff Report, the
Study prepared by TJKM and the documents and other evidence presented during the
public hearing; now, therefore, be it
RESOLVED, that the Danville Town Council finds that the above recitals are true and
correct and have served, together with the supporting documents, as the basis for the
findings and approvals set forth below; and, be it further
RESOLVED, that the Danville Town Council accepts the Parking In Lieu Fee Nexus
Study prepared by TJKM and determines that the Study contains the required elements
of the Mitigation Fee Act, specifically Government Code Section 66001:
• Purpose of the fee. The purpose of the fee is to help pay for public parking in
Downtown Danville needed to accommodate required off-site parking for Areas
1, 2,2A, 3 and 11 of the Downtown Business District.
• Use of fee revenues. The fees will be uses to provide additional public parking at
new lots to be constructed (Rose Street Municipal Parking Lot, CIP Project C-105
and Village Theatre Parking Lot, CIP Project B-597) and to add additional
parking, including a potential parking deck at any of the Town's existing
municipal parking lots.
• Reasonable relationship betzwen use of the fee and projects paying the fee. Areas 1, 2,
2A, 3 and 11 of the DBD are required to provide a minimum of 25-50% of their
required parking off-site in municipal parking lots. This requirement allows for
additional density and more parking intense uses on the affected properties that
could not be achieved without off-site parking.
• Reasonable relationship betzwen the need for public parking and doumtoum development.
All new development generates the need for additional parking. The 2016
Downtown Parking Utilization Assessment determined that there is sufficient
existing public parking to accommodate existing development in the Downtown
Core. However, there is remaining development potential within the Downtown
Core that will generate the need for approximately 380 additional public parking
spaces.
• Reasonable relationship between the amount of the fee and the cost of providing parking.
The cost to provide public parking in Downtown Danville ranges from $45,000
(no land acquisition required) to $69,000 (land acquisition required) per parking
space. The recommended fee of $3,500 per space for retail uses and $15,250 per
space for all other uses would generate approximately $5.79 million in fees
towards an estimated cost of $21.79 million to provide the 380 additional spaces
needed, or approximately 25% of the total cost.
and, be it further
RESOLVED, that the Town Council approves the following fee schedule for parking in
lieu fees, to be included in the Town's Master Fee Schedule:
• $3,500 per space for retail uses
• $15,250 per space for all other uses

• The fee shall be adjusted each year as part of the Master Fee Schedule by
the increase, if any, in the San Francisco Bay Area Consumer Price Index,
not to exceed 2% per year.
and, be it further
RESOLVED, that these fees shall go into effect 60 days after adoption of this resolution.
