APPROPRIATING ADDITIONAL FUNDS AND AUTHORIZING THE
EXECUTION OF AN AMENDED CONTRACT FOR ENVIRONMENTAL
CONSULTING SERVICES FOR THE PREPARATION OF AN
ENVIRONMENTAL IMPACT REPORT ASSOCIATED
WITH THE 359 AND 375 WEST EL PINTADO ROAD
RESIDENTIAL DEVELOPMENT APPLICATION
WHEREAS, Talmont Homes has submitted an application to allow for the development of
a 1.88 -acre site consisting of two existing parcels identified as 359 and 375 West El Pintado
Road; and
WHEREAS, the subject site is also identified by Assessor's Parcel Numbers 200-140-011 and
200-140-012; and
WHEREAS, the proposal includes a General Plan Amendment for the 359 West El Pintado
Road portion of the site, a Preliminary Development Plan - Rezoning request, and a Final
Development Plan - Major Subdivision request which would: (1) re -designate a .29 acre
portion of the site from Residential - Single Family - Low Density (1-3 units per acre) to a
Mixed Use land use designation; (2) rezone the property from R-15; Single Family
Residential District and 0-1; Limited Office District to P-1; Planned Unit Development
District; and (3) subdivide the site to allow for a 44 unit multifamily condominium
development.
WHEREAS, the Town has determined that, pursuant to the requirements of the California
Environmental Quality Act (CEQA), in order to disclose all potentially significant
environmental impacts associated with the project, the preparation of an Environmental
Impact Report will be required; and
WHEREAS, on November 17, 2015, the Town Council authorized the Town Manager to
execute an agreement for the amount of $75,546.00 with Rincon Consultants, Inc. for the
preparation of an Environmental Impact Report; and
WHEREAS, Rincon Consultants, Inc. has requested additional funds in the amount of
$26,527.00 to cover work associated with a Town -required expanded scope for the Traffic
Impact Analysis, additional unanticipated work related to the Biological Study, and related
additional administrative overhead costs; now, therefore, be it
RESOLVED, that the Danville Town Council authorizes the Town Manager to execute an
amended agreement with Rincon Consultants, Inc. for the preparation of an Environmental
Impact Report; and be it further
RESOLVED, that an additional $26,527.00 is appropriated for the preparation of the
Environmental Impact Report.
