HomeMy WebLinkAbout113-2016RESOLUTION NO. 113-2016 APPROVING HISTORIC PRESERVATION INCENTIVES RELATED TO THE RESTORATION OF, AND ADDITION TO, THE HISTORIC STRUCTURE LOCATED AT 375 HARTZ AVENUE (APN: 199-330-016) WHEREAS JOHN & SHARON DESOUSA are the owners of the subject property located at 375 Hartz Avenue; and WHEREAS, the property owners are requesting that the historic structure located at 375 Hartz Avenue be designated as a Town Heritage Resource; and WHEREAS, the property owners are requesting approval of a Heritage Resource Incentive Package; and WHEREAS, Chapter 32-72 of the Preservation) requires the Heritage recommend the Historic Preservation approval; and Danville Municipal Code (Historic Resource Commission review and Incentives Package for Town Council WHEREAS, the Danville Planning Commission and Heritage Resource Commission approved Development Plan and Variance applications for the 375 Hartz Avenue project (under Development Plan request DEV16-0103 and Variance request VAR16-0103) on October 11, 2016, authorizing exterior fagade improvements to the front elevation, construction of a 1,721 +/- square foot second story addition and a 195 +/- square foot deck at the rear of the building, construction of a 45 +/- square foot addition to the rear ground floor, and construction of a 35 +/- square foot trash room to the existing historic building; and WHEREAS, the Danville Heritage Resource Commission also approved a resolution recommending that the Town Council approve the Historic Preservation Incentives Package; now, therefore, be it RESOLVED that the Danville Town Council approves a Historic Preservation Incentives Package for 375 Hartz Avenue that includes the following: 1. Commitment by the Town to assist the developer in any efforts they undertake to obtain Federal and/or State historic preservation grants and/or aid; 2. Upon the Town Council's approval of 375 Hartz Avenue as a Town Designated Heritage Resource, authorizes the Town Manager, on behalf of the Town, to enter into and execute a Mills Act Contract with the property owner, potentially providing for a reduction in property taxes associated with the historic building; 3. Authorizes application of the provisions of the Historic Building Code to work involving the historic building; 4. Upon the Town Council's approval of 375 Hartz Avenue as a Town Designated Heritage Resource, provides a Heritage Resource identification plaque for the building; 5. Waive all Town off-site parking in -lieu fees associated with the creation of an additional off-site parking demand of 6.26 spaces as a result of this project. This parking demand is determined assuming a retail use for the ground floor commercial space and an office use on the second floor. If uses with a higher parking demand occupy any portion of the site, as calculated per the Municipal Code (e.g., restaurant or personal service uses), the applicant shall make payment to the Town an in -lieu parking fee in the amount of $7,000.00 (or the amount of the payment in effect at the time of the establishment of the use) for each additional one parking space need. The off-site parking in -lieu fee to be waived has been preliminarily estimated to be $43,330.00. 6. Waive all other Town -controlled fees (except plan check fees where outside plan check consultant review services are utilized) associated with the issuance of building permits for the historic building (estimated at $12,087.00); and 7. Inclusion of 375 Hartz Avenue in all marketing plans and public information brochures developed and maintained by the Town of Danville to increase public awareness of the Town's Historic Preservation Program.
