APPROVING REVISED FINAL DEVELOPMENT PLAN REQUEST DEV16-0003
ALLOWING A PRIVATE VEHICULAR GATE FOR THE ALAMO SPRINGS
NEIGHBORHOOD
WHEREAS, the ALAMO SPRINGS HOMEOWNERS ASSOCIATION (Applicant/ Owner) has
requested approval of a revised Final Development Plan (DEV16-0003) application to amend
the Condition of Approval of Town Council Resolution No. 172-96 prohibiting a gated entrance
and allowing the installation of a private vehicular gate for the Alamo Springs neighborhood;
and
WHEREAS, the subject site is located on Alamo Springs Road, just north of I-680; and
WHEREAS, the Town of Danville 2030 General Plan, Policy 1.13 stated that "Unless overriding
public safety considerations exist, prohibit the development of "gated" communities in
Danville;" and
WHEREAS, the Danville Planning Commission did review the project on September 13, 2016,
and did approve Planning Commission Resolution No. 2016-08 recommending that the Town
Council approve the request; and
WHEREAS, a staff report was submitted recommending that the Town Council approve the
request; and
WHEREAS, the Town Council did review the project during a regular meeting on October 4,
2016; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, the Town Council did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Danville Town Council approves Development Plan request DEV16-0003
per the conditions of approval contained herein, and makes the following findings in support
of this action:
FINDINGS
1. There have been two recent crime incidents in the Alamo Springs neighborhood of
particular concern due to their violent nature.
2. The Alamo Springs neighborhood is in close proximity to the 1-680 on and off ramps at
both El Pintado Road and El Cerro Road, providing easy access to the neighborhood for
would be criminals.
3. The Alamo Springs neighborhood is relatively isolated, located at the end of a long
private driveway at the end of La Gonda Way, and consists of relatively large lots. These
characteristics are not conducive to casual surveillance (neighbors being able to watch
other neighbor's property) compared to more densely populated and open
neighborhoods. In addition, the configuration of the lots does not lend itself to the use of
individual gates for the residences in the neighborhood. The secluded nature of the area,
coupled with easy escape routes, can make the area more susceptible to crime.
4. The Alamo Springs neighborhood is well suited for the installation of a vehicular gate
due to the single, long access roadway leading to the neighborhood. The installation of a
gate at this single point would allow for the controlled access of all vehicles entering the
neighborhood.
5. Overflow parking impacts on La Gonda Way and Alamo Springs Drive, generated by
activities at nearby Hap Magee Ranch Park, have resulted in illegal parking in the turn-
around area at the terminus of La Gonda Way and along both sides of lower portion of
Alamo Spring Drive. Illegal parking in these areas results in a substandard affective
roadway width and can impair emergency vehicle access to and from the Alamo Springs
neighborhood.
CONDITIONS OF APPROVAL
Unless otherwise specified, the following conditions shall be complied with prior to the
issuance of a building permit for the project. Each item is subject to review and approval by the
Planning Division unless otherwise specified.
1. This Revised Final Development Plan approval (DEV16-0003) modifies Town Council
Resolution No. 172-96 and authorizes the installation of a private vehicular gate on
Alamo Springs Drive for the Alamo Springs neighborhood. Except as may be modified
by the conditions contained herein, development shall be substantially as shown on the
project plans as follows:
a. Entry Exhibit and Site Distance Exhibit, as prepared by Aliquot, dated
7/15/2016.
b. Landscape Plan as prepared by Allied Landscape, dated 7/15/2016.

2. Prior to installation of the gate, the applicant shall provide proof to the Town that
Contra Costa County has approved a revised Final Development Plan amending the
previously approved conditions of approval and allowing for the proposed vehicular
gate.
3. Appropriate signage and/or speed bumps on Alamo Springs Drive and La Gonda Way
providing warning of the presence of the gate shall be installed concurrently with the
installation of the gate to the satisfaction of the Town's Engineering and Transportation
Divisions. In addition, the necessity of signage and/or red curbs to prohibit parking on
La Gonda Way near the gate shall be determined by the Town prior to issuance of
building permits for the gate. Signage/ parking restriction plans and details shall be
submitted to the Town for review and approval prior to the Town's issuance of Building
Permits for the gate.
4. Appropriate signage shall be installed regarding the separate "Residents" and
"Guest" drive aisles at the gate entry.
5. Open pedestrian access shall be maintained at all times over the pedestrian sidewalk
along Alamo Springs Drive/ La Gonda Way.
6. Final landscape and irrigation plans shall be submitted for review and approval by the
Planning Division prior to issuance of building permits for the project.
7. Any damage to public or private street improvements resulting from the installation of
the vehicular gate shall be repaired to the satisfaction of the City Engineer, at full
expense to the applicant.
8. The existing CC&Rs for the project shall be modified to include the shared maintenance
of the private vehicular gate and all related improvement, as may be found necessary
and to the satisfaction of the City Attorney.
9. All new utilities necessary to serve the vehicular gate shall be installed underground.
10. The Alamo Springs Homeowners Association shall provide the Danville Police
Department, San Ramon Valley Fire Protection District, U.S. Postal Service, garbage
service provider, and all other service providers with the code or key to manually
operate the vehicular gate. Written evidence that this condition has been satisfied shall
be submitted to the Town prior to operation of the gate.
