HomeMy WebLinkAbout059-2016RESOLUTION NO. 59-2016 ACCEPTING TRANSFER OF PROPERTY FROM THE SUCCESSOR AGENCY TO THE FORMER COMMUNITY DEVELOPMENT AGENCY OF THE TOWN OF DANVILLE (APN 199-330-051) WHEREAS, in 1992 the Town's former Community Development Agency (the "former CDA") acquired title to a small parcel of land (APN 199-330-051) located immediately north of 115-125 Hartz Avenue; and WHEREAS, since its acquisition, the property has been used as part of the public parking lot at the corner of Railroad and Hartz Avenues; and WHEREAS, upon dissolution of the former CDA in 2011, title to the property was transferred to the Trust Fund of the Successor Agency to the Former Community Development Agency of the Town of Danville (the "Successor Agency"); and WHEREAS, on March 1, 2016, the Successor Agency adopted Resolution No. 25-2016, approving an amendment to the Successor Agency's Long Range Property Management Plan, which proposed to transfer title of the property to the Town through a grant deed as a governmental use property pursuant to Health and Safety Code Sections 34181(a)(2) and 34191.3; and WHEREAS, the Amended Long Range Property Management Plan was approved by the Successor Agency's Oversight Board on March 28, 2016 and by the California Department of Finance on May 27,2016; and WHEREAS, as a governmental use property, the property shall be transferred to the Town at no cost and shall continue to be used as a public parking lot; now, therefore, be it RESOLVED, that the Town of Danville hereby accepts the transfer of title to APN 199- 330-051 as a public parking lot as provided for in Health and Safety Code Sections 34181(x)(2) and 34191.3; and, be it further RESOLVED, that the City Clerk is directed to have a Certificate of Acceptance attached to the grant deed and have it recorded with the Contra Costa County Recorder's office together with a. certified copy of this resolution.
