AUTHORIZING THE INITIATION OF A GENERAL PLAN AMENDMENT
STUDY TO CONSIDER THE MERITS OF APPLYING A MIXED USE
LAND USE DESIGNATION INVOLVING A.29 ACRE
LOT LOCATED AT 359 WEST EL PINTADO
(APN: 200-140-012 - TALMONT HOMES)
WHEREAS, Talmont Homes (Applicant) and GMMR (Owner) have requested
initiation of a General Plan Amendment Study involving a .29 acre lot located at 359
West El Pintado; and
WHEREAS, the applicant has proposed a 38 unit townhouse development on two
parcels totaling 1.88 +/- acres identified as 359 and 375 West El Pintado; and
WHEREAS, the request includes a General Plan Amendment to change the General
Plan land use designation for the .29 +/- acre lot from Residential - Single Family -
Low Density (1-3 units per acre), matching the existing General Plan land use
designation of larger 1.59 +/- acre parcel included in the development; and
WHEREAS, the Town of Danville requires Town Council authorization prior to
preparation of a General Plan Amendment Study; and
WHEREAS, the Town Council did consider the applicant's request at a noticed
public hearing on December 15, 2015; and
WHEREAS, the Town Council did hear and consider all reports, recommendations,
and testimony submitted in writing and presented at the hearing; now, therefore, be
it
RESOLVED, that the Danville Town Council concurs with the recommendation of
staff and authorizes the preparation of a General Plan Amendment Study; and, be it
further
RESOLVED, it is appropriate that an Environmental Impact Report be prepared for
the project to study potential environmental impacts including biological, traffic
noise, and land use compatibility, and that potential alternate developments be
evaluated as part of that process; and, be it further
RESOLVED, that the applicant is directed to design the project to anticipate
possible future development of the properties identified as 266 and 267 Elsie Drive,
including the provision of shared access; and, be it further
RESOLVED, the applicant is directed to review and consider the architectural and
land plan characteristics of the following high-quality residential projects recently
developed in Danville for consideration of options for a residential - multiple family
- low/ medium density or high/ medium density use on the property:
• Stony Brook - depicting a for -sale motor -court housing product providing
for the 13 to 17 dwelling units per acre land use designation range
• Ryland Cottages - depicting a for -sale single family detached housing
product providing for the 7 to 12 dwelling units per acre land use
designation range
• Sequoia Grove Apartments (aka "Podva Apartments") - depicting a for -
rent housing product providing for the 18 to 22 dwelling units per acre
land use designation.
and, be it further
RESOLVED, that in authorizing the above-mentioned General Plan Amendment
Study, the Town Council is not indicating any predisposition to approve the
requested General Plan Amendment.

2015, by the following vote:
