HomeMy WebLinkAbout072-2015Recorded at request of: Town of Danville When recorded, mail to: Town of Danville City Clerk 510 LaGonda Way Danville, CA 94526-1740 IIII III I 111111111111111 CONTRA COSTA Co Recorder Office JOSEPH CANCIAMILLA, Clerk --Recorder DOC— 2015-0189696-00 Check Number Friday, SEP 11, 2015 11:24:41 Cl FRE $0.00' TII Pd $0,h Nbr-0007384919 LLL t RW t 1-2 RESOLUTION NO. 72-2015 ACCEPTING PUBLIC IMPROVEMENTS AND DEDICATIONS AND ESTABLISHING THE SATISFACTORY COMPLETION OF PRIVATE IMPROVEMENTS FOR SD 9335 (TYLER COURT), LOCATED AT THE CORNER OF DIABLO ROAD AND EL CERRO BOULEVARD WHEREAS, KT Builders, is the subdivider of said subdivision; and WHEREAS, the subdivider has requested the Town of Danville accept said subdivision improvements as complete and accept the dedications offered to the Town of Danville on the recorded subdivision map of Subdivision 9335 (521 M 17); and WHEREAS, the City Engineer has advised that the improvements required as a condition of that subdivision agreement between the Town of Danville and said subdivider have been satisfactorily completed; and WHEREAS, said subdivision lies within the corporate limits of the Town of Danville; and WHEREAS, it is now in the interest of the Town of Danville to: 1. accept those dedications and easements on said subdivision map for the benefit and use of the general public; and 2. establish those private improvements as complete within said subdivision; and WHEREAS, the Danville Town Council must act affirmatively in order for the subdivision improvements and dedications to be accepted; now, therefore, be it RESOLVED, that the Danville Town Council accepts the following dedications offered for the public benefit within this subdivision: 1. Relinquishment of Abutter Rights along Diablo Road, 2. Public Utility Easement(s) (P.U.E.) abutting and including Tyler Court; and, be it further RESOLVED, that the Town of Danville hereby accepts those public improvements installed as a condition of this subdivision agreement; and, be it further RESOLVED, that the Town of Danville hereby establishes those private improvements as complete within this subdivision; and, be it further RESOLVED, that Town staff is authorized and directed to release those securities required as a condition of this subdivision in accordance with the Danville Municipal Code.
