APPROVING HISTORIC PRESERVATION INCENTIVES RELATED TO
THE RESTORATION OF THE HISTORIC STRUCTURE AND
THE REDEVELOPMENT OF THE PROPERTY LOCATED
AT 120 WEST LINDA MESA AVENUE
(APN: 199-330-013)
WHEREAS, ARDAVAN ONSORI (Owner/ Applicant) is the owner of the property
located at 120 West Linda Mesa Avenue; and
WHEREAS, the property owner is requesting that the historic structure on this site,
known as the Austin Root House, be designated as a Danville Heritage Resource; and
WHEREAS, the property owner received approval of a Development Plan (under
Development Plan request DEV13-0029) on October 29, 2013, authorizing the
relocation of the existing historic structure on the property to be moved forward and
to the right (east) on the lot and to be placed on a new foundation and restored; the
construction of 1,370 +/- square feet of new first floor commercial floor space, the
construction of three new second floor residential units totaling 2,940 +/- square feet,
and the construction of three single car garages, storage, and electrical room totaling
995 +/- square feet; and
WHEREAS, the property owner is requesting a Heritage Preservation Incentive
Package related to the Development Plan approvals and the preservation and
restoration of the historic structure on the site; and
WHEREAS, Chapter 32-72 of the Danville Municipal Code (Historic Preservation)
requires the Heritage Resource Commission review and recommend a Heritage
Resource Incentive Package for Town Council approval; and
WHEREAS, the Danville Heritage Resource Commission held a public hearing on
October 29, 2013, and approved a resolution recommending that the Town Council
approve the Heritage Preservation Incentive Package; and
WHEREAS, the Danville Town Council held a public hearing and approved the
Historic Preservation Incentive Package on November 19, 2013, and;
WHEREAS, the applicant has requested that the Town reconsider the Historic
Preservation Incentive Package and waive all costs associated with the acquisition of
700 +/- square feet of excess public right-of-way; now, therefore, be it
RESOLVED that the Danville Town Council approves a Heritage Resource Incentive
Package for 120 West Linda Mesa that includes the following:
1. Commitment by the Town to assist the developer in any efforts they undertake
to obtain Federal and/or State historic preservation grants and/or aid;
2. Upon the Town Council's approval of the Austin Root House as Town
Designated Heritage Resource, authorizes the Town Manager, on behalf of the
Town, to enter into and execute a Mills Act Contract with the property owner,
potentially providing for a reduction in property taxes associated with the
historic building;
3. Authorizes application of the provisions of the Historic Building Code to work
involving the two historic buildings;
4. Upon the Town Council's approval of the Austin Root House as Town
Designated Heritage Resources, provides a Heritage Resource identification
plaque for the building;
5. Waive all Town off-site parking in -lieu fees associated with the creation of an
additional off-site parking demand of 7.6 spaces as a result of this project. This
parking demand is determined assuming service office or service commercial
uses for the ground floor commercial space and the area constituting the
residential use on the second floor. If uses with a higher parking demand
occupy any portion of the site, as calculated per the Municipal Code (e.g.,
restaurant or personal service uses), the applicant shall make payment to the
Town an in -lieu parking fee in the amount of $7,000.00 (or the amount of the
payment in effect at the time of the establishment of the use) for each additional
one parking space need. The off-site parking in -lieu fee to be waived has been
estimated to be $42,560.00.
6. Waive costs associated with the purchase of approximately 700 square feet of
Town -owned public right-of-way along the site's Railroad Avenue frontage
(estimated at $49,000.00).
7. Waives all other Town -controlled fees (except plan check fees where outside
plan check consultant review services are utilized) associated with the issuance
of building permits for the project, including Stormwater Pollution Program
fees ($641.00); Child Care Facility fees ($950.00); Commercial and Residential
Transportation Improvement Program (TIP) fees ($10,990.00); Park Dedication
Fee ($17,772.00), and; building permit fees ($6,800.00); and

8. Inclusion of the Austin Root House in all marketing plans and public
information brochures developed and maintained by the Town of Danville to
increase public awareness of the Town's Historic Preservation Program.

the following vote:
