HomeMy WebLinkAbout005-2015RESOLUTION NO. 5-2015 AWARDING A CONSTRUCTION CONTRACT AND AUTHORIZING AN AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT FOR THE RAILROAD AVENUE IMPROVEMENTS PROJECT - PROSPECT AVENUE TO SCHOOL STREET, CIP NO. C-405 WHEREAS, the Danville Town Council has previously appropriated funding for the Railroad Avenue Improvements Project, CIP No. C-405, in the adopted Capital Improvement Program; and WHEREAS, a construction contract for the project was awarded on July 15, 2014, according to Resolution No. 57-2014, and said contract was subsequently terminated on November 17,2014; and WHEREAS, the Danville Town Council authorized an emergency storm drain repair pursuant to California Public Contract Code Sections 20168 and 22050 on December 9, 2014, according to Resolution No. 89-2014; and WHEREAS, the project was redesigned so bids could again be solicited from contractors; and WHEREAS, the redesign effort was accomplished under a Professional Services Agreement with Carlson, Barbee & Gibson, Inc., (CBG) as authorized by Resolution Nos. 103-2012 and 34-2014; and WHEREAS, CBG has requested an amendment to the Professional Services Agreement to increase the design contract by $15,200; and WHEREAS, the redesigned plans and specifications for the proposed work have been reviewed and approved by the City Engineer; and WHEREAS, the City Clerk of this Town did, in open session on the 20th day of January, 2015, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the lowest responsive bidder is GradeTech Inc. of San Ramon, California, at $1,269,872.65; and WHEREAS, the Town received a bid protest from the second lowest bidder, Ghilotti Construction Company of Santa Rosa, California, asserting that the GradeTech bid failed to properly disclose work to be performed by subcontractors as required by the bid documents and Public Contract Code §4104; and WHEREAS, the City Attorney determined that GradeTech's omission was an inconsequential variance which afforded them no advantage or benefit, and therefore recommends awarding a construction contract for the project to GradeTech Inc.; and WHEREAS, the project has been found to be Categorically Exempt from the California Environmental Quality Act (CEQA) according to Guidelines Section 15301 (Class 1); now, therefore, be it RESOLVED, by the Danville Town Council, that the Town award the construction contract for the Railroad Avenue Improvements Project, CIP No. C-405 to GradeTech Inc. of San Ramon, California; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute, on behalf of the Town, a written contract with GradeTech Inc. of San Ramon, California for $1,269,872.65, and authorize use of a 10% contingency of $126,987.27, for a total construction budget of $1,396,859.92 for work in connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager be authorized to execute an amendment to the Professional Services Agreement with Carlson, Barbee & Gibson, Inc., and increase the design contract by $15,200 for the necessary redesign work; and, be it further RESOLVED, that the Town shall within five (5) days of the adoption of this resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings.)
