HomeMy WebLinkAbout077-2014RESOLUTION NO. 77 -2014 AUTHORIZING AN AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH NOLTE VERTICAL FIVE FOR THE HARTZ AVENUE BEAUTIFICATION PROJECT, CIP NOS. C -391 AND C -319 WHEREAS, the Town had previously entered into an agreement with Nolte Associates, Inc., for design of Project C -319 via Resolution No. 63 -98, but the project was never constructed; and WHEREAS, the Town executed a new Professional Services Agreement with Nolte Associates, Inc., on October 7, 2008, as authorized by Resolution No. 115 -2008, to resurrect, update, and combine the plans for Projects C -391 and C -319 into one for bidding and construction, but the project was suspended pending acquisition of needed right -of -way; and WHEREAS, the Town terminated the agreement with Nolte Associates, Inc., on August 9, 2011, and entered into a new Professional Services Agreement with Nolte Vertical Five (NV5) to complete the plans, specifications, and estimate based on current design standards; and WHEREAS, the agreement with NV5 includes a not -to- exceed budget of $158,849; and WHEREAS, NV5, having recently completed the plans, specifications, and estimate for the project has requested an amendment to their current agreement that would increase the not -to- exceed budget by $68,093, for a new not -to- exceed budget of $226,942; and WHEREAS, NV5 has submitted a proposal dated September 4, 2014 that includes an amended scope -of -work and budget for assisting the Town with implementation of the project; and WHEREAS, sufficient funds have been budgeted in the adopted 2014115 Operating Budget and Capital Improvement Program for Projects C -391 and C -319 "Hartz Avenue Beautification Project "; now, therefore, be it RESOLVED, by the Danville Town Council that the Town Manager be and hereby is authorized to execute, on behalf of the Town, an amendment to the Professional Services Agreement with Nolte Vertical Five, thereby increasing the not -to- exceed budget by $68,093 for a new not -to- exceed budget of $226,942.
