APPROVING THE SATISFACTORY COMPLETION OF PRIVATE
IMPROVEMENTS FOR SUBDIVISION 8641, LOCATED AT O'BRIEN DRIVE,
EAST OF WEBER LANE; AND ACCEPTING GRANT DEED FOR PARCLE B, THE
HILL ROAD BRIDGE, LOCATED ON HILL ROAD, NORTH OF DIABLO ROAD
WHEREAS, Davidon Homes, subdivider of said subdivision; and
WHEREAS, the subdivider has requested the Town of Danville accept said subdivision
improvements as complete; and
WHEREAS, the City Engineer has advised that the private improvements required as a
condition of that subdivision agreement between the Town of Danville and said subdivider
have been satisfactorily completed; and
WHEREAS, the Homeowner's Association for the subdivision has granted Parcel B in
satisfaction of Condition B.3 of Subdivision 8641; and
WHEREAS, the Planning Commission has found that acquisition of Parcel B to use as a
pedestrian bridge to link existing public trails is in conformance with the Town's General
Plan; and
WHEREAS, said subdivision lies within the corporate limits of the Town of Danville; and
WHEREAS, it is now in the interest of the Town of Danville to establish that those private
improvements are complete; and
WHEREAS, the Danville Town Council must act affirmatively in order to approve the
improvements as being satisfactorily completed; and now, therefore, be it
RESOLVED, that those private improvements required by said subdivision agreement are
satisfactory; and, be it further
RESOLVED, that Town staff is authorized and directed to release those securities required
as a condition of this subdivision in accordance with the Danville Municipal Code; and, be
it further
RESOLVED, that the Town hereby accepts the Grant Deed to Parcel B, the Hill Road
Bridge, and directs the City Clerk to have the deed recorded.
APPROVED by the Danville 'Town Council at a regular meeting on October 7, 2014, by the
following vote:
