HomeMy WebLinkAbout076-2014RESOLUTION NO. 76-2014 APPROVING THE SATISFACTORY COMPLETION OF PRIVATE IMPROVEMENTS FOR SUBDIVISION 8641, LOCATED AT O'BRIEN DRIVE, EAST OF WEBER LANE; AND ACCEPTING GRANT DEED FOR PARCLE B, THE HILL ROAD BRIDGE, LOCATED ON HILL ROAD, NORTH OF DIABLO ROAD WHEREAS, Davidon Homes, subdivider of said subdivision; and WHEREAS, the subdivider has requested the Town of Danville accept said subdivision improvements as complete; and WHEREAS, the City Engineer has advised that the private improvements required as a condition of that subdivision agreement between the Town of Danville and said subdivider have been satisfactorily completed; and WHEREAS, the Homeowner's Association for the subdivision has granted Parcel B in satisfaction of Condition B.3 of Subdivision 8641; and WHEREAS, the Planning Commission has found that acquisition of Parcel B to use as a pedestrian bridge to link existing public trails is in conformance with the Town's General Plan; and WHEREAS, said subdivision lies within the corporate limits of the Town of Danville; and WHEREAS, it is now in the interest of the Town of Danville to establish that those private improvements are complete; and WHEREAS, the Danville Town Council must act affirmatively in order to approve the improvements as being satisfactorily completed; and now, therefore, be it RESOLVED, that those private improvements required by said subdivision agreement are satisfactory; and, be it further RESOLVED, that Town staff is authorized and directed to release those securities required as a condition of this subdivision in accordance with the Danville Municipal Code; and, be it further RESOLVED, that the Town hereby accepts the Grant Deed to Parcel B, the Hill Road Bridge, and directs the City Clerk to have the deed recorded.
