APPROVING THE ACQUISITION OF RIGHT OF WAY ON SAN RAMON VALLEY
BOULEVARD FROM THE
EAST BAY MUNICIPAL UTILITY DISTRICT (APN 208 - 230 -018)
WHEREAS, the Town of Danville required the subdivider of the Elworthy Ranch
subdivision to construct frontage improvements on that property, including widening
San Ramon Valley Boulevard from two travel lanes to four, constructing a pedestrian
sidewalk to connect to Downtown Danville and constructing bike lanes along San
Ramon Valley Boulevard (the "Subdivision Improvements "); and
WHEREAS, in 2010 the Town entered into a Development Agreement with the
Elworthy Ranch subdivider in which the subdivider agreed to extend the Subdivision
Improvements across a parcel to the north of the Elworthy Ranch owned by the East
Bay Municipal Utility District ( "EBMUD) if the Town could acquire the necessary right -
of -way; and
WHEREAS, the Town has reached an agreement with EBMUD to acquire
approximately 1,889 square feet of right -of -way and a temporary construction
easement, which will allow for extension of the Subdivision Improvements across the
EBMUD parcel; now, therefore, be it
RESOLVED, that the Danville Town Council approves the acquisition of the right -of-
way across the EBMUD parcel and authorizes the Town Manager to execute any
documents necessary to complete the acquisition.
APPROVED by the Danville Town Council at a special meeting on July 8, 2014 by the
following vote:
