AUTHORIZING AN AGREEMENT FOR RELINQUISHMENT OF ABUTTER'S
RIGHTS AT 222 RAILROAD AVENUE; RAILROAD AVENUE IMPROVEMENTS,
CIP NO. C -405
WHEREAS, the Danville Town Council has appropriated funding for the Railroad Avenue
Improvements Project, CIP No. C -405 in the 2013/14 Capital Improvement Program; and
WHEREAS, the project includes new sidewalk, curb and gutter, street trees, and
underground utilities along the frontage of the property at 222 Railroad Avenue (APN 208-
023 -017); and
WHEREAS, said property is owned by The John and Marie Theresa Lagos Trust; and
WHEREAS, the project will convert private perpendicular parking currently enjoyed by
the owner to time - restricted parallel public parking within the right -of -way; and
WHEREAS, in exchange for relinquishing abutter's rights to this private parking, the Town
has agreed to pay $20,000 to The John and Marie Theresa Lagos Trust according to an
Agreement for Relinquishment of Abutter's Rights - 222 Railroad Avenue to be executed and
recorded with the owner; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, the Agreement for Relinquishment of Abutter's
Rights - 222 Railroad Avenue with The John and Marie Theresa Lagos Trust; and, be it
further
RESOLVED, by the Danville Town Council, that $20,000 in appropriated funds from CIP
No. C -405 be used to issue payment to The John and Marie Theresa Lagos Trust according
to the amount stipulated in the agreement.
