AWARDING A CONSTRUCTION CONTRACT AND APPROPRIATING
ADDITIONAL FUNDING FOR THE SYCAMORE CREEK PEDESTRIAN TRAIL
REHABILITATION, OLD ORCHARD DRIVE TO PARK HILL ROAD PROJECT,
CIP NO. B -120
WHEREAS, the Danville Town Council adopted a Draft Mitigated Negative
Declaration of Environmental Significance and approved a Call for Bids for the
Sycamore Creek Pedestrian Trail Rehabilitation, Old Orchard Drive to Park Hill Road
Project, CIP No. B -120, on February 5, 2013 according to Resolution No. 16 -2013; and
WHEREAS, the City Clerk of this Town did, in open session on the 30th day of July,
2013, publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, the lowest responsive bidder is A -1 Ready Mix of Hayward, CA; and the
City Engineer has recommended awarding a construction contract for the project to said
contractor; and
WHEREAS, funding has been appropriated in Contract No. B -120 of the adopted
Capital Improvement Program for the project, yet an additional appropriation is needed
to award the construction contract and authorize a construction contingency; now,
therefore, be it
RESOLVED, by the Danville Town Council, that the Town award the construction
contract for the Sycamore Creek Pedestrian Trail Rehabilitation, Old Orchard Drive to
Park Hill Road, CIP No. B -120 to A -1 Ready Mix of Hayward, CA; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract to A -1 Ready Mix of
Hayward, CA, for $183,300 and authorize use of a 10% contingency of $18,330 for a total
construction budget of $201,630 for work in connection therewith, and the City Clerk is
hereby directed to attest same and affix thereto the official seal of the Town; and, be it
further
RESOLVED, that an appropriation from CIP General Purpose Revenue in an amount
equal to $19,139 in Fiscal Year 2013/14 be authorized to fully fund the project; and, be it
further
RESOLVED, that the Town shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101.
(Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards
of such findings.)
