HomeMy WebLinkAbout070-2013 RESOLUTION NO. 70-2013 APPROVING MAP AND SUBDIVISION IMPROVEMENT AGREEMENT FOR SUBDIVISION 9287 ON T ASSAJARA LANE, AUTHORIZING A LICENSE AGREEMENT FOR PRIVATE LANDSCAPE MAINTENANCE ON TOWN-OWNED PROPERTY, AND ABANDONMENT OF PUBLIC EASEMENTS AND ACCEPTANCE OF REPLACEMENT EASEMENTS WHEREAS, Ryder Tassajara, LLC, subdivider of said subdivision, has requested the Town of Danville approve said Subdivision Map and Subdivision Improvement Agreement; and WHEREAS, the Subdivision Map and Subdivision Improvement Agreement comply with standards set forth in the California Subdivision Map Act and Danville Municipal Code; and WHEREAS, subdivider has now complied with all Conditions of Approval established by Resolution No. 126-2010 adopted on November 16, 2012, for the subject subdivision; and WHEREAS, said subdivision lies within the corporate limits of the Town of Danville; and WHEREAS, this Subdivision Map and Subdivision Improvement Agreement are consistent with the Town's General Plan; and WHEREAS, Ryder Tassajara, LLC, has asked the Town to abandon existing easements for Public Street & Utility Purposes and Landscape Maintenance & Public Access Purposes originally granted on December 19, 1996 (Series No. 96-235213) in exchange for replacement public easements to be dedicated as part of Subdivision 9287 ; and WHEREAS, Ryder Tassajara, LLC, has asked the Town to execute a License Agreement that will allow the subdivider to landscape a portion of the Town-owned property (APN 215-090-037) and will require the Homeowner's Association to maintain the landscaping in perpetuity; now therefore be it RESOLVED, that the Subdivision Map for Subdivision 9287 and Subdivision Improvement Agreement are hereby approved; and, be further it RESOLVED, that the Town Council hereby abandons the easements for Public Street & Utility Purposes and Landscape Maintenance & Public Access Purposes originally dedicated on December 19, 1996, as Series No. 96-235213, as allowed by Subdivision Map Act § 66434(g); and, be it further RESOLVED, that the Town Council hereby accepts replacement public easements and dedications offered with Subdivision 9287; and be it further RESOLVED, that the Town Council hereby authorizes the Town Manager to execute a License Agreement that allows subdivider to landscape a portion of Town-owned property at APN 215-090-037 and allows the Homeowner's Association to maintain said landscaping in perpetuity.
