HomeMy WebLinkAbout2014-02ORDINANCE NO. 2014-02 APPROVING PRELIMINARY DEVELOPMENT PLAN - REZONING REQUEST LEG12 -0001 (PODVA PROPERTY - PONDEROSA HOMES) The Town Council of the Town of Danville does ordain as follows: SECTION 1. Rezoning. The 109 +/- acre site, located in southwest Danville at the western terminus of Midland Way, and further identified as APNs: 208 - 160 -007 & 008, is rezoned from A -2; General Agricultural District to P -1 Planned Unit Development District (LEG12- 0001). Rezoning is based upon approved Major Subdivision SD 9309, Final Development Plan DEV14- 0011, Tree Removal TR14 -0007; and the findings and conditions of approval contained within Town Council Resolution No. 28 -2014. Resolution No. 28 -2014 and all attachments thereto, are hereby incorporated by reference. SECTION 2. Zoning Map. The zoning map has been amended accordingly. SECTION 3. Publication. The City Clerk shall either a) have this ordinance published once within 15 days after adoption in a newspaper of general circulation or b) have a summary of this ordinance published twice in a newspaper of general circulation once five days before its adoption and again within 15 days after adoption. SECTION 4. Effective Date. This ordinance becomes effective 30 days after its adoption. The foregoing ordinance was first read and introduced on April 1, 2014, and approved and adopted by the Danville Town Council at a regular meeting on April 15, 2014, by the following vote: AYES - Storer, Doyle, Arnerich, Morgan, Stepper NOES: - None ABSTAIN: - None ABSENT: - None AYOR APPROVED AS TO FORM: I CITY ATTORNEY CLERK'S CERTIFICATE I, Marie Sunseri, City Clerk of the Town of Danville, hereby certify that the foregoing is a true and accurate copy of Ordinance No. 2014 -02 of said Town and that said ordinance was ublished according to law.
