HomeMy WebLinkAbout2013-05 ORDINANCE NO 200153 APPROVING ZONING TEXT AMENDMENT REQUEST AND PRELIMINARY DEVELOPMENT PLAN REZONING REQUEST LEG1302 ZTA PUD AMENDING DIVISION 3245 DBD DOWNTOWN BUSINESS DISTRICT OF THE DANVILLE MUNICIPAL CODE TO CREATE DEVELOPMENT STANDARDS FOR DBD AREA 12 MULTIFAMILY RESIDENTIAL HIGH DENSITY DISTRICT 2530 UNITS PER ACRE REVISING THE LIST OF ALLOWABLE USES THAT MAY BE ESTABLISHED IN DBD AREA 3 OLD TOWN MIXED USE DISTRICT TO INCLUDE EMERGENCY SHELTERS AS AN ALLOWED USE MAKING OTHER MINOR REVISIONS TO DIVISION 3245 AND REZONING THE426 ACRE DANVILLE OFFICE PARTNERS LLC PROPERTY FROM DBD DOWNTOWN BUSINESS DISTRICT AREA 6 BUSINESS AND PROFESSIONAL OFFICE TO DBD DOWNTOWN BUSINESS DISTRICT AREA 12 MULTIFAMILY RESIDENTIAL HIGH DENSITY 2530 UNITS PER ACRE 372383 Diablo Road The Town Council of the Town of Danville does ordain as follows SECTION 1 REPEALING EXISTING SECTION 3245 OF THE DANVILLE MUNICIPAL CODE The existing Section 3245 of the Danville Municipal Code is hereby repealed in its entirety SECTION 2 ADDING NEW REPLACEMENT SECTION 3245 TO THE DANVILLE MUNICIPAL CODE A new Section 3245 is hereby added to the Danville Municipal Code as reflected by Exhibit 1 of this Ordinance SECTION 3 ZONING MAP AMENDED The426 acre Danville Office Partners Property commonly known as 372383 Diablo Road and further identified as APN 216120037 is rezoned from DBD Downtown Business District Area 6 Business and Professional Office to DBD Downtown Business District Area 12 Multifamily Residential High Density 2530 units per acre Rezoning is based upon approved Zoning Text Amendment request and Preliminary Development Plan Rezoning request LEG1302 ZTA PUD and the findings and conditions of approval contained within Town Council Resolution No 922013 and all attachments thereto hereby incorporated by reference Danvill e SECTION 4 ZONING MAP The Zoning Map of the Town of Danville is amended accordingly LEG1302 ZTA and PUD i APN 216 120037 Town of Danville I I 1 ii s UaFr J JLr 7 1 InCtM3SiJ 1 j M 1 1 rc Office Partners LLC Property 4Y tom7l SECTION 5 PUBLICATION The City Clerk shall either a have this ordinance published once within 15 days after adoption in a newspaper of general circulation or b have a summary of this ordinance published twice in a newspaper of general circulation once five days before its adoption and again within 15 days after adoption SECTION 6 EFFECTIVE DATE This ordinance becomes effective 30 days after its adoption PAGE 2 OF ORDINANCE NO 200153 The foregoing ordinance was first read and introduced on November 5 2013 and approved and adopted by the Danville Town Council at a regular meeting on November 19 2013 by the following vote AYES Arnerich Storer Doyle Morgar NOES None ABSTAIN None ABSENT None APPROVED AS TO FORM CITY ATTORNEY CSLERK CERTIFICATE I Marie Sunseri City Clerk of the Town of Danville hereby certify that the foregoing is a true and accurate copy of Ordinance No 201305 of said Town and that said ordinance was published according to law Dated 12614 F 0 4 City Clerk of the own of Danville PAGE 3 OF ORDINANCE NO 200153
