MATADERA WAY, FRONTING SUBDIVISION 8919
WHEREAS, Davidon Homes constructed public improvements according to the
Conditions of Approval for Subdivision 8919; and
WHEREAS, a portion of the public sidewalk was constructed on private property as
follows:
Parcel A owned by Matadera Maintenance Corporation (APN 196- 320 -016)
Lot 6 owned by Aymen and Atef Shahid (APN 196- 310 -012)
Lot 7 owned by Davidon Homes (APN 196- 310 -013)
Lot 8 owned by Davidon Homes (APN 196- 310 -014)
Lot 9 owned by Davidon Homes (APN 196- 310 -015); and
WHEREAS, Grants of Easement have been executed by each property owner to
memorialize the public's right to utilize the public sidewalk across the properties; and
WHEREAS, action by the Town Council is necessary to accept the easements; and
WHEREAS, it is in the Town's best interest to accept the easements; now, therefore, be it
RESOLVED, that the Danville Town Council accepts the Grants of Easement, as
executed by the Matadera Maintenance Corporation, Davidon Homes, and Aymen and
Atef Shahid; and, be it further
RESOLVED, that the City Clerk is hereby directed to attach a Certificate of Acceptance
to each easement document and have each recorded at the Contra Costa County
Recorder's Office.
