HomeMy WebLinkAbout052-2013RESOLUTION NO. 52-2013 APPROPRIATING ADDITIONAL FUNDS AND AUTHORIZING THE EXECUTION OF AN AMENDED CONTRACT FOR ENVIRONMENTAL CONSULTING SERVICES FOR PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT ASSOCIATED WITH THE MAGEE RANCH - SUMMERHILL RESIDENTIAL DEVELOPMENT APPLICATION WHEREAS, SummerHill Homes submitted an application to allow for the development of the 410 + /- acre Magee Ranch property located on the south side of Diablo Road and Blackhawk Road extending approximately two miles east from the intersection of Diablo Road/ Green Valley Road/ McCauley Road; and WHEREAS, the subject site is also identified by Assessor's Parcel Numbers 202 - 050 -071, 073, 074, 078, 079, and 080,202-100-017,019,038, and 040, 215 - 040 -002; and WHEREAS, the project application includes a Preliminary Development Plan - Rezoning and Final Development Plan - Major Subdivision request to rezone the property from A -4; Agricultural Preserve District, A -2; General Agricultural District, and P -1; Planned Unit Development District to a new P -1; Planned Unit Development District and the subdivision of the site to create 69 single family residential lots which would be clustered in the lower portions of the site; and WHEREAS, on July 20, 2010, the Danville Town Council approved Resolution No. 85- 2010, approving a contract for environmental consulting services with the firm of Denise Duffy and Associates and appropriating a total of $174,281.00 for preparation of the Environmental Impact Report (EIR) for the project; and WHEREAS, on June 6, 2012, the Danville Town Council approved Resolution No. 72- 2012 approving and amendment to the contract and appropriating an additional $109,546.50; and WHEREAS, Denise Duffy and Associates has requested approval of an additional amendment to the contract providing for additional funds in the amount of $60,625.00 to cover additional work scope items related to traffic, circulation, and biology; and WHEREAS, the applicant, SummerHill Homes, will incur all costs associated with the completion of this EIR and including administrative costs equal to 33% of the contract amount to cover Town costs associated with preparation of the EIR; now, therefore, be it RESOLVED, that the Danville Town Council authorizes the Danville Town Manager to execute an amended contract for environmental consulting services for the preparation of an Environmental Impact Report associated with the Magee Ranch - SummerHill residential development proposal; and, be it further RESOLVED, that $60,625.00 in additional funds be appropriated for the preparation of the Environmental Impact Report.
