HomeMy WebLinkAbout036-2013RESOLUTION NO. 36-2013 APPROVING A SECOND AMENDMENT TO THE CONSULTANT SERVICES AGREEMENT WITH VERDE DESIGN, INC. FOR THE OSAGE STATION PARK MASTER PLAN, PROJECT NO. B -490 WHEREAS, the Town entered into a Consultant Services Agreement with Verde Design, Inc. on July 6, 2010, for Landscape Architectural services associated with conceptual planning and design support for the Osage Station Park Master Plan, Project No. B -490; and WHEREAS, the agreement was previously amended on March 29, 2012 using funds from the previously authorized design contingency; and WHEREAS, Paragraph 3A "Compensation" limits total compensation to $142,660; and WHEREAS, the agreement was previously amended to increase compensation by $14,145 for a total of $156,805; and WHEREAS, Consultant has presented a Request for Change Order to the Town dated March 25, 2013, that includes a description of new or amended tasks together with a request for additional compensation of up to $10,000 for a total not -to- exceed budget of $166,805; and WHEREAS, the scope of services must be expanded, and the total compensation limit increased in order for the Consultant to continue providing uninterrupted service to the Town; and WHEREAS, the City Engineer is recommending that the total compensation limit be increased for Verde Design, Inc.'s contract; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute in duplicate, on behalf of the Town, an amendment to the Consultant Services Agreement with Verde Design, Inc. for the Osage Station Park Master Plan, Project No. B -490, which addresses the following changes: 1. "Scope of Services" of the agreement is hereby amended to include the additional work described in Verde Design Inc.'s revised proposal to the Town dated March 25, 2013. 2. 3A "Compensation" of the agreement is hereby amended to indicate compensation not -to- exceed, One Hundred Sixty -Six Thousand Eight Hundred Five Dollars ($166,805) which equates to an increase of Ten Thousand Dollars ($10,000). 3. All other provisions of the original agreement remain unchanged.
