WEIR, Clerk - Recorder DOC— 2 013 - 0009910 -00 Check Number Monday, JAN 14, 2013 09:26:53 FRE $0.0011 Tt l Pd $0.00 Rcpt 4 0001535246 CLM /RV /1 -2 RESOLUTION NO. 107-2011 APPROVING A PARCEL MAP, AND ACCEPTING IMPROVEMENTS AND DEDICATIONS FOR MINOR SUBDIVISION MS 855 -2008, LOCATED AT 400 STARVIEW DRIVE WHEREAS, Athan Poulos of 400 Starview Drive LLC, subdivider of said subdivision, has requested the Town of Danville approve said Parcel Map; and WHEREAS, the Parcel Map complies with standards set forth in the California Subdivision Map Act and the Danville Municipal Code; and WHEREAS, subdivider has now completed all required subdivision improvements and complied with all applicable Conditions of Approval established by Planning Commission Resolution No. 2009 -12 adopted on April 28, 2009, for the subject minor subdivision; and WHEREAS, subdivider has requested the Town of Danville accept said subdivision improvements as complete, accept the dedications offered to the Town of Danville on the said parcel map, and release the subdivision improvement securities associated with said improvements; and WHEREAS, said minor subdivision lies within the corporate limits of the Town of Danville; and WHEREAS, this Parcel Map is consistent with the Town's General Plan; and WHEREAS, it is now in the interest of the Town of Danville to: 1. accept those dedications of easements on said parcel map; and 2. accept as complete those improvements installed as a condition of this minor subdivision; and 0 WHEREAS, The Danville Town Council must act affirmatively in order for the subdivision improvements and dedications to be accepted; now, therefore, be it RESOLVED, that the Parcel Map is hereby approved and Town staff is hereby authorized and directed to execute the same on behalf of the Town; and, be it further RESOLVED, that the Danville Town Council accepts the following dedication offered within this subdivision: 1. A Structural Setback Easement on Parcels 1 through 4; and, be it further RESOLVED, that the Town of Danville hereby accepts as complete those improvements installed as a condition of this minor subdivision; and, be it further RESOLVED, that Town staff is hereby authorized and directed to release subdivision improvement securities associated with said improvements 90 days after acceptance of said improvements, or later if so directed by the City Engineer, in accordance with Danville Municipal Code X19 -7.6 and 19 -7.9.
