HomeMy WebLinkAbout146-2012RESOLUTION NO. 146-2012 AUTHORIZING AMENDMENTS TO THE PROFESSIONAL SERVICES AGREEMENT FOR CONSTRUCTION MANAGEMENT SERVICES AT THE VETERANS MEMORIAL BUILDING, CIP NOS. B -510 AND C -546 WHEREAS, the Town entered into a Professional Services Agreement with The Covello Group on February 17, 2010, for professional services associated with renovation of the Veterans Memorial Building located at 400 Hartz Avenue, Danville CIP B -510 (formerly A -510); and WHEREAS, Paragraph 3A of said agreement stipulates that compensation shall not exceed $351,400 and that the construction phase not exceed fourteen months; and WHEREAS, said agreement was previously amended on September 20, 2011 (Resolution No. 83 -2011) and on January 10, 2012 (Resolution No. 4- 2012), in order to increase the total compensation to $487,060 and to add seven months of on -site construction management service; and WHEREAS, the actual construction phase extended to twenty -two months total; and WHEREAS, The Covello Group requested an increase in the compensation limit to add one month of on -site construction management service (Amendment #3) and to assist the Town in evaluating the legitimacy of change orders submitted by the contractor (Amendment #4); and WHEREAS, the total compensation limit must be increased in order for Consultant to provide the necessary service to the Town; and WHEREAS, the City Engineer is recommending that the total compensation limit be increased; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town Manager is hereby authorized and directed to execute Amendment #3 and Amendment #4 to the Professional Services Agreement with The Covello Group to increase the compensation limit by $26,230 for a not -to- exceed budget of $513,290. APPROVED by the Danville Town Council at a regular meeting on December 18, 2012 by the following vote: AYES: Arnerich, Storer, Doyle, Morgar.
