HomeMy WebLinkAbout118-2012RESOLUTION NO. 118-2012 AUTHORIZING THE TOWN MANAGER TO EXECUTE A POWER PURCHASE AGREEMENT WITH PREPAY FOR THE FINANCING AND CONSTRUCTION OF CAPITAL IMPROVEMENT PROGRAM PROJECT A -531- SOLAR PHOTOVOLTAIC SYSTEM AND APPROPRIATE $1,274,579 FROM THE CAPITAL IMPROVEMENT PROGRAM GENERAL PURPOSE REVENUE ACCOUNT WHEREAS, the Town of Danville prepared the 2012113 through 2016117 Capital Improvement Program (CIP); and WHEREAS, the Town Council approved the Solar Photovoltaic System Project (A -531) and directed that a proposal be obtained for installation of the energy system; and WHEREAS, on April 10, 2012 proposals were reviewed and evaluated pursuant to Section 4217.16 of the California Government Code for the financing of solar photovoltaic electric generating equipment; and WHEREAS, pursuant to Section 4217.13 of the California Government Code for the financing of solar photovoltaic electric generating equipment certain findings must be made; and WHEREAS, a noticed public hearing was held as required by Section 4217.13 of the California Government Code; and WHEREAS, sufficient funds for the proposed project are contained within the CIP General Purpose Revenue; and WHEREAS, the Town Council wishes to enter into a facility financing contract and a facility ground lease on terms that are in the best interest of the Town of Danville at the four sites shown in Exhibit 1, hereby made a part of this resolution; now, therefore, be it RESOLVED, that the Danville Town Council has determined that the facility financing contract and facility ground lease for Project A -531 - Solar Photovoltaic System is in the best interest of the Town of Danville; and, be it further RESOLVED, that the Danville Town Council finds that funds for the repayment of the financing of the energy conservation facility are projected to be available from the revenues resulting from the sales of electricity from the solar facility or from funding that would otherwise have been used for purchase of electrical energy required by the Town of Danville in the absence of the energy conservation facility; and, be it further RESOLVED, that the Danville Town Council hereby appropriates $1,274,579 from CIP General Purpose Revenue; and, be it further RESOLVED, that the Danville Town Council directs the Town Manager to execute a solar power purchase agreement (facility financing contract and facility ground lease) with SolarCity Corporation, 3055 Clearview Way, San Mateo, California.
