HomeMy WebLinkAbout112-2012RESOLUTION NO. 112-2012 AUTHORIZING THE TOWN MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING FOR THE PROVISION OF READJUSTMENT COUNSELING AT THE VETERANS MEMORIAL BUILDING WHEREAS, the U.S. Department of Veterans Affairs has requested use of the second floor office at the Veterans Memorial Building for the provision of Post - Traumatic Stress Disorder (PTSD) and readjustment counseling to veterans; and WHEREAS, the U.S. Department of Veterans Affairs' use of the second floor office would be consistent with the intended use of the space and the Town's Joint Use and Maintenance Agreement with the Danville Veterans Memorial Building Board of Trustees; and WHEREAS, at the Board of Trustees unanimously approved the Memorandum of Understanding at its regular meeting of July 10, 2012; now, therefore, be it RESOLVED, that the Danville Town Council authorizes the Town Manager to execute a Memorandum of Understanding Between the Town of Danville, United States Department of Veterans Affairs and the Danville Veterans Memorial Building Board of Trustees for the Provision of Readjustment Counseling at the Veterans Memorial Building (Exhibit 1). APPROVED by the Danville Town Council at a regular meeting on August 14, 2012 by the following vote: AYES Arnerich, Storer, Doyle, StPnnPr NOES: None ABSTAINED: None ABSENT: None APPROVED AS TO FORM: fel_��e, % CITY ATTORNEY ATTEST: CITY CLERK MEMORANDUM OF UNDERSTANDING BETWEEN THE TOWN OF DANVILLE, UNITED STATES DEPARTMENT OF VETERANS AFFAIRS AND THE DANVILLE VETERANS MEMORIAL BUILDING BOARD OF TRUSTEES FOR THE PROVISION OF READJUSTMENT COUNSELING AT THE VETERANS MEMORIAL BUILDING This Memorandum of Understanding (MOU) is between the Town of Danville ( "Town'), Danville Veterans Memorial Building Board of Trustees ( "Trustees "), and the U.S. Department of Veterans Affairs, Concord Vet Center ( "Vet Center ") for the provision of readjustment counseling at the Veterans Memorial Building ( "Building "). 1 Recitals 1.1 The Vet Center is committed to providing readjustment counseling services to eligible Veterans in the local community. Outreach activities to include establishing off site locations are one of the many ways to better serve the veteran population in the surrounding communities. 1.2 The Vet Center is part of the Pacific Western Region Readjustment Counseling Service. The Vet Center serves combat Veterans, and their families and significant others. Services include Post Traumatic Stress Disorder (PTSD) and readjustment counseling, outreach to special populations of Veterans, and community services. 1.3 All collaborative efforts between the Town, Trustees and Vet Center will be guided by the following principles: ■ Patient rights will be respected at all times. ■ Exceptional courtesy to patient and staff members. • Decision - making and inter - facility collaborations will be in the best interest of patients. • Information and resources will be shared to best meet the needs of patients. 1.4 All attempts will be made to accommodate Veterans and maintain excellent working relationships between both organizations. 2 Coordination 2.1 The Vet Center's Team Leader and the designated representative of the Trustees will meet quarterly to coordinate and resolve any operating issues. 3 Use of Space 3.1 The Town and Trustees will provide the Vet Center available office space to provide services. EXHIBIT 1 TO RESOLUTION NO. 112-2012 3.2 The Town shall provide one key/ access card to the Vet Center's designated representative for the purpose of gaining access to the building and office space. The Vet Center will be responsible for assuring the Building is secure upon conclusion of any Veterans' group use and /or activity. 3.3 The Town shall provide all ongoing maintenance, including custodial support for the office. This custodial and maintenance support shall be provided at a level and on a schedule that is consistent with the standards established for other Town -owned and managed community centers. 3.4 The Town shall provide all utilities for the office, including electricity. The Town shall assume the cost for all utilities except cable, telephone, computer and Internet services in the Veterans Wing. 3.5 The Vet Center shall not assign, sublet or transfer the Building access, room access and/or use rights included in this agreement to any other organization without prior written consent of the Town, and then only upon such terms and conditions as the Town may set forth in writing. 3.6 The Town shall have the right to make, at its own cost and expense, any alternations and improvements that may be required and proceed as needed in the interest of public safety. All and any alternations or improvements shall become property of the Town. The Vet Center may make improvements to their office at their own expense, provided the Trustees and Town approve the improvements in advance. 4 Provision of Services 4.1 The Vet Center will provide readjustment counseling, referrals to health care, and support in obtaining other U.S. Department of Veterans Affairs benefits. The Vet Center staff does not provide medical services. Insurance and Liability The Vet Center is a part of the U.S. Department of Veterans Affairs and liability of Vet Center staff is governed by Federal law. Support facility staff will be under the Concord Vet Center Team Leader oversight and functional supervision while providing medical and clinical services in the Concord Vet Center.
