HomeMy WebLinkAbout074-2012RESOLUTION NO. 74-2012 DESIGNATING CERTAIN DEFINED VOLUNTEERS AS COVERED BY WORKERS COMPENSATION BENEFITS PURSUANT TO LABOR CODE SECTION 3363.5 WHEREAS, the Town of Danville receives voluntary services without pay from designated community volunteers; and WHEREAS, these volunteers provide important services to the Town and are vital to the Towns ability to provide quality services to residents; and WHEREAS, the Town desires to afford such persons coverage for injuries incurred in the course and scope of providing such volunteer services; now, therefore, be it RESOLVED, by the Danville Town Council that pursuant to Labor Code Section 3363.5: 1. Any person who performs authorized, assigned and defined voluntary services without pay to the Town of Danville shall be considered an employee of the Town for purposes of workers' compensation coverage only while performing such volunteer services as defined and directed by the Town. 2. For purposes of this resolution, "voluntary services without pay" shall include services performed by any person who received no remuneration from the Town other than meals, transportation, lodging or reimbursement for incidental expenses.
