HomeMy WebLinkAbout045-2012RESOLUTION NO. 45-2012 DIRECTING THE TOWN MANAGER TO CAST BALLOTS IN FAVOR OF THE "2012 COMMUNITY CLEAN WATER INITIATIVE" FOR TOWN -OWNED PROPERTIES WHEREAS, the Federal Water Pollution Control Act requires dischargers of stormwater to obtain a National Pollutant Discharge Elimination System permit from the San Francisco Regional Water Quality Control Board; and WHEREAS, all Contra Costa County cities including Danville, the County, and the Contra Costa County Flood Control and Water Conservation District have joined to secure the required permit by jointly operating and funding the Contra Costa Clean Water Program ( CCCWP); and WHEREAS, in 2009 the San Francisco Regional Water Quality Control Board adopted costly regulations ( NPDES Permit No. CAS612008) in the Municipal Regional Permit (MRP) that applies to all nine Bay Area Counties; and WHEREAS, the Town complies with the NPDES permit requirements by operating a local Stormwater Pollution Control Program and participating regionally to implement MRP requirements to minimize or eliminate pollutants from entering stormwater; and WHEREAS, the new clean water regulations imposed in 2009 are an unfunded mandate without a dedicated funding source and could result in a significant fiscal impact upon the Town General Fund; and WHEREAS, the CCCWP has developed a proposal known as the 2012 Community Clean Water Initiative where a property - related fee for all municipalities in the County would provide additional funding for stormwater permit implementation and drainage system maintenance; and WHEREAS, such fee is being submitted to all property owners for consideration through a mailed ballot pursuant to the provisions of Article XIIID of the California Constitution (Proposition 218); and WHEREAS, 51% of returned ballots must vote in favor of the fee in order for the initiative to pass; and WHEREAS, the Town of Danville owns 30 separate parcels that would be subject to said fee; now, therefore, be it RESOLVED, that the Danville Town Council authorizes and directs the Town Manager to cast ballots in favor of the 2012 Community Clean Water Initiative for all parcels owned by the Town of Danville, and to submit those ballots to the proper authority by April 6, 2012; and be it further RESOLVED, that the Town Council, acting as the successor Agency to the former Community Development Agency, directs the Town Manager to cast ballots in favor of the 2012 Community Clean Water Initiative for all parcels owned by the Community Development Agency of the Town of Danville that are returned to the ownership of the Town of Danville.
