HomeMy WebLinkAbout039-2012RESOLUTION NO. 39 -2012 AWARDING A CONSTRUCTION CONTRACT AND APPROPRIATING ADDITIONAL FUNDING FOR THE TASSAJARA RANCH DRIVE MEDIAN IMPROVMENTS PROJECT, CIP NO. C -240 WHEREAS, the Danville Town Council has appropriated funding for the Tassajara Ranch Drive Median Improvements Project, CIP No. C -240 in the adopted 2011/2012 Capital Improvement Program; and WHEREAS, the Danville Town Council approved a call for bids for the project on December 21, 2010 in Resolution No. 133 -2010; and WHEREAS, the City Clerk of this Town did, in open session on the 6th day of March, 2012, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the apparent low bidder is MCK Services, of Martinez, CA; and WHEREAS, the Town's design consultant, Harrison Engineering Inc., has requested a third amendment to increase the design budget by an additional $8,589 for a total not - to- exceed budget of $108,260; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town award the construction contract for the Tassajara Ranch Drive Median Project to MCK Services, of Martinez, CA; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute, on behalf of the Town, a written contract with MCK Services, of Martinez, CA, for $499,888 and authorize use of a 10% contingency of $49,988.80 for a total construction budget of $549,876.80 for work in connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and, be it further RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings.); and, be it further RESOLVED, that the Town Manager be authorized to execute a third contract amendment with Harrison Engineering Inc. in the amount of $8,589 for a not -to- exceed design budget of $108,260; and, be it further RESOLVED, that an additional appropriation from SCC fees be approved in an amount equal to $25,682 in Fiscal Year 2011/12 to fully fund the project. APPROVED by the Danville Town Council at a regular meeting on March 20, 2012, by the following vote: AYES: Arnerich, Doyle, Storer NOES: None ABSTAINED: Andersen ABSENT: Stepper AYOR ".
