APPROVING HISTORIC PRESERVATION INCENTIVES RELATED TO THE
REHABILITATION OF THE HISTORIC STRUCTURE AND REDEVELOPMENT
OF THE PROPERTY LOCATED AT 160 EAST PROSPECT AVENUE
(APN: 208 - 010 -004 - WEINBERG)
WHEREAS, Todd and Jill Weinberg are the owner of the subject property located at 160
east Prospect Avenue which contains an existing historic structure; and
WHEREAS, the Planning Commission and Heritage Resource Commission jointly
approved a Development Plan and Variance request (DEV10- 0076), which allowed: the
existing historic structure on the property to be moved forward on the lot and to be
placed on a new foundation; the construction of a 2,018 +/- square foot ground floor,
second story, and basement addition to the existing structure; the construction of three
new two -story residential units to the rear, two of which are proposed to be 1,117 +/-
square feet and one is proposed to be 1,026 +/- square feet in size, and; a 234 +/- square
foot single car garage for each unit; and
WHEREAS, Chapter 32 -72 of the Danville Municipal Code (Historic Preservation)
allows the Heritage Resource Commission to review and recommend historic
preservation incentives to the Town Council; and
WHEREAS, the Heritage Resource Commission did approve Resolution No. 2011 -04
recommending the Town Council approve a historic preservation incentive package;
and
WHEREAS, the Danville Town Council did review the historic preservation incentive
package during a regular meeting on November 15, 2011; now, therefore, be it
RESOLVED, that the Danville Town Council approves the historic preservation
incentives for 160 East Prospect Avenue including the following provisions:
1. Commits the Town to assist the property owner in any efforts they undertake to
obtain Federal and/or State historic preservation grants and aid;
2. Upon the Town Council's approval of the structure as Designated Heritage
Resource, authorizes the Town Manager, on behalf of the Town, to enter into and
execute a Mills Act Contract with the property owner, potentially providing for a
reduction in property taxes associated with the historic structure;
3. Waives Commercial Transportation Improvement Program (CTIP) fees ($4,514)
and the Residential Transportation Improvement Program (RTIP) fees ($6,000).
4. Authorizes application of the provisions of the Historic Building Code to the
historic structure;
5. Upon the Town Council's approval of the structure as a Town Designated
Heritage Resource, provides a Heritage Resource identification plaque for the
site;
6. Waives all Building Inspection (except plan check fees), child care, stormwater,
Engineering and Planning fees associated with the issuance of building permits
(equaling approximately $8,300); and
7. Includes the site in all marketing plans and public information brochures
developed to increase the public's awareness of the Town's Historic Preservation
Program.
8. Waives off -site parking in -lieu fees associated with the residential units and
office use of the second floor of the historic structure, retail use of the ground
floor, and storage use of the basement (equaling $34,300). The applicant will be
responsible for the payment of off -site parking in -lieu fees associated with any
increased parking demand (generated by higher parking demand uses such as
restaurant or personal services).
9. Waiver of Park Dedication fees for the three residential units totaling $18,509.
APPROVED by the Danville Town Council at a regular meeting on November 15, 2011,
by the following vote:
