ACCEPTING OFFERS OF DEDICATION FOR ROADWAY PURPOSES
(195 HARTZ AND 115 -125 HARTZ AVENUE)
WHEREAS, the Towns Capital Improvement Project C -319 (Hartz Avenue
Beautification -Linda Mesa to Railroad) will provide new street, sidewalk and
related improvements along the west side of Hartz Avenue; and
WHEREAS, in order to construct Project C -319, the Town must acquire public
right -of -way along several properties on Hartz Avenue and in order to acquire
these rights -of -way has had appraisals prepared; and
WHEREAS, sufficient funds have been appropriated for Project C -319 for such
acquisitions; and
WHEREAS, the owner of 195 Hartz Avenue (the Rosalind A. Joseph I. Hirsch
Trust) has agreed to dedicate the required right -of -way along their property to
the Town; and
WHEREAS, the owner of 115 -125 Hartz Avenue (the Community Development
Agency of the Town of Danville) has agreed to dedicate the required right -of-
way along their property to the Town; and
WHEREAS, it is in the best interests of the Town to accept the offers of
dedication; and
WHEREAS, the Town must act affirmatively to accept the offers of dedication;
now, therefore, be it
RESOLVED, that the Town of Danville hereby accepts the Irrevocable Offers of
Dedication for Roadway Purposes for 195 Hartz Avenue (APN 199 - 330 -010) and
115 -125 Hartz Avenue (APN 199 - 330 -035); and, be it further
RESOLVED, that the City Clerk is directed to have a Certificate of Acceptance
attached to each Offer of Dedication and have them recorded with the Contra
Costa County Recorder's office together with a certified copy of this resolution;
and, be it further
RESOLVED, that the Town Manager is authorized to complete the acquisition of
the right -of -way from the owner of 195 Hartz Avenue for the purchase price of
$103,368.
APPROVED by the Danville Town Council at a regular meeting on July 5, 2011,
by the following vote:
AYES: Stepper, Andersen, Arnerich, Doyle, Storer
