APPROVING HISTORIC PRESERVATION INCENTIVES FOR THE HISTORIC
JAMES ROOT HOUSE LOCATED AT 90 RAILROAD AVENUE
(APN: 208 - 022 -014 -- CHASE)
WHEREAS, Craig and Cara Chase are the owner of the subject property located at 90
Railroad Avenue which contains the existing historic structure known as the James Root
House; and
WHEREAS, Chapter 32 -72 of the Danville Municipal Code (Historic Preservation)
requires the Heritage Resource Commission to review and recommend historic
preservation incentives to the Town Council; and
WHEREAS, the Planning Commission and Heritage Resource Commission jointly
approved a Development Plan and Variance request (DEV08- 0062), which included the
construction of a detached, two -story 3,144 +/- square foot building to the rear of the
existing historic James Root House building; and
WHEREAS, the Heritage Resource Commission did approve Resolution No. 2010 -02
recommending the Town Council approve a historic preservation incentive package;
and
WHEREAS, the Danville Town Council did review the historic preservation incentive
package during a regular meeting on November 16, 2010; now, therefore, be it
RESOLVED, that the Danville Town Council approves the historic preservation
incentives for 90 Railroad Aveue including the following provisions:
1. Waive parking fees as follows:
a) If the first and second floor tenant spaces are occupied by land uses which
generate a parking demand of 1 space per 225 square feet or less, all
parking fees shall be waived (a savings of $97,813.00 based on service
office uses for the entire 3,144 square feet of new floor area for the project).
b) For uses with a higher parking demand than 1 space per 225 square feet,
as calculated per the Municipal Code, the applicant shall be required to
pay the Town a parking fee in the amount of $7,000.00 for each additional
parking space required. The proposed restaurant use for the ground floor
of the new building, including a maximum of 40 interior seats and 32
exterior seats, would result in a parking fee requirement of $84,840.
2. Commits the Town to assist the property owner in any efforts they undertake to
obtain Federal and/or State historic preservation grants and aid;
3. Authorizes the Town Manager, on behalf of the Town, to enter into and execute a
Mills Act Contract with the property owner, potentially providing for a
reduction in property taxes associated with the historic structure;
4. Waives Transportation Improvement Program (TIP) fees ($4.50 for 2,542 square
feet of new conditioned space equaling $11,439.00);
5. Authorizes application of the provisions of the Historic Building Code to the
historic structure;
6. Upon the Town Council's approval of the James Root House as a Town
Designated Heritage Resource, provides a Heritage Resource identification
plaque for the site;
7. Waives all Building Inspection (except plan check fees), child care, stormwater,
Engineering and Planning fees associated with the issuance of building permits
(equaling approximately $6,000); and
8. Upon the Town Council's approval of the James Root House as a Town
Designated Heritage Resource, includes the site in all marketing plans and public
information brochures developed to increase the public's awareness of the
Towns Historic Preservation Program.
