HomeMy WebLinkAbout125-2010RESOLUTION NO. 125-2010 RATIFYING AND MODIFYING SAN RAMON VALLEY FIRE PROTECTION DISTRICT ORDINANCE NO. 23 PERTAINING TO BUILDING AND FIRE STANDARDS FOR APPLICATION WITHIN THE JURISDICTIONAL BOUNDARIES OF THE TOWN OF DANVILLE WHEREAS, the Town of Danville lies within the jurisdictional boundaries of the San Ramon Valley Fire Protection District; and WHEREAS, the San Ramon Valley Fire Protection District has responsibility for fire protection within said jurisdictional boundaries; and WHEREAS, the San Ramon Valley Fire Protection District did on November 18, 2010, adopt Ordinance No. 23, an Ordinance adopting the 2010 Edition of the California Fire Code and the 2009 Edition of the International Fire Code, including local amendments; and WHEREAS, the amendments contained in Ordinance No. 23 constitute amendments to building standards relating to fire and panic safety adopted by the State Fire Marshal and contained in the California Building Standards Code; and WHEREAS, pursuant to Section 13869.7(c) of the California Health and Safety Code, the Town may ratify, modify or deny the amendments contained in Ordinance No. 23 and the amendments shall not become effective within the jurisdictional boundaries of the Town of Danville until ratified by the Town Council; and, WHEREAS, the Town of Danville wishes to modify the amendments contained in Ordinance No. 23 and ratify the remainder of the ordinance; now, therefore, be it RESOLVED, that the Danville Town Council hereby ratifies and modifies San Ramon Valley Fire Protection District Ordinance No. 23 to be effective in the Town of Danville as follows: Ordinance No. 23 is modified within the jurisdictional boundaries of the Town of Danville by deleting the following amendments contained in the Ordinance. All other provisions of Ordinance No. 23 are hereby ratified by the Town of Danville. "- Section 902 is amended to add certain definitions and read as follows: SUBSTANTIAL REMODEL. In existing buildings, any alteration that causes additional floor area that is more than twenty -five percent (25%) of the existing floor area and where the total floor area exceeds 5000 square feet. SUBSTANTIAL REMODEL, Group R -3. In an existing R -3 structure, any alteration that causes additional floor area that exceeds fifty percent (50 %) of the existing floor area and where the total floor area exceeds 5000 square feet. - Section 903 is amended and reads as follows: 903.1 General. Automatic sprinkler systems shall comply with this section. For the purposes of this section, fire walls shall not be considered as creating separate buildings. An automatic sprinkler system shall be provided for all new buildings with a gross floor area that exceeds 5000 square feet and in the locations set forth in Section 903. Exception: Group U occupancies. 903.2.1.1 Group A -1. An automatic sprinkler system shall be provided for Group A -1 occupancies where one of the following conditions exists: 1. The fire area exceeds 5000 square feet. 2. The fire area has an occupant load of 300 or more. 3. The fire area is located on a floor other than a level of exit discharge serving such occupancies. 4. The fire area contains a multitheatre complex. 903.2.1.3 Group A -3. An automatic sprinkler system shall be provided for Group A -3 occupancies where one of the following conditions exists: 1. The fire area exceeds 5000 square feet. 2. The fire area has an occupant load of 300 or more. 3. The fire area is located on a floor other than a level of exit discharge serving such occupancies. 903.2.1.4 Group A-4. An automatic sprinkler system shall be provided for Group A-4 occupancies where one of the following conditions exists: 1. The fire area exceeds 5000 square feet 2. The fire area has an occupant load of 300 or more. 3. The fire area is located on a floor other than a level of exit discharge serving such occupancies. 903.2.2.1 Group B. An automatic sprinkler system shall be provided for Group B occupancies where one of the following conditions exists: 1. The fire area exceeds 5000 square feet. Except as provided for in Section 903.2.3.1 for a new public school campus an automatic sprinkler system shall be provided for Group E occupancies as follows: 1. Throughout all Group E fire areas greater than 5000 square feet in area. 2. Throughout every portion of educational buildings below the lowest level of exit discharge serving that portion of the building. Exception: An automatic sprinkler system is not required in any area below the lowest level of exit discharge serving that area where every classroom throughout the building has at least one exterior exit door at ground level. 903.2.4 Group F -1. An automatic sprinkler system shall be provided throughout all buildings containing a Group F -1 occupancy where one of the following conditions exists: 1. A Group F -1 fire area exceeds 5000 square feet. 2. A Group F -1 fire area is located more than three stories above grade plane. 903.2.7 Group M. An automatic sprinkler system shall be provided throughout buildings containing a Group M occupancy where one of the following conditions exists: 1. A Group M fire area exceeds 5000 square feet. 2. A Group M fire area is located more than three stories above grade plane. 3. A Group M occupancy is used for the display and sale of upholstered furniture. 903.2.9 Group S -1. An automatic sprinkler system shall be provided throughout all buildings containing a Group S-1 occupancy where one of the following conditions exists: 1. A Group S-1 fire area exceeds 5000 square feet 2. A Group S-1 fire area is located more than three stories above grade plane. 903.2.9.1 Repair garages. An automatic sprinkler system shall be provided throughout all buildings used as repair garages in accordance with Section 406 of the California Building Code, as shown: 1. Buildings with a Repair Garage where the fire area exceeds 5000 square feet. 2. Buildings with repair garages servicing vehicles parked in basements. PAGE 3 OF RESOLUTION NO. 125-2010 903.2.10 Group S -2 enclosed parking garages. An automatic sprinkler system shall be provided throughout buildings classified as enclosed parking garages in accordance with Section 406.4 of the California Building Code as follows: 1. Where the fire area of the enclosed parking garage exceeds 5000 square feet; or 2. Where the enclosed parking garage is located beneath other occupancy groups. - Section 903.6.3 is added and reads as follows: 903.6.3 Substantial Remodel. In an existing building, if a substantial remodel occurs the entire building shall be protected by an automatic sprinkler system in accordance with section 903. - Section 903.6.3.1 is added and reads as follows: 903.6.3.1 Substantial Remodel, Group R -3. An automatic sprinkler system shall be provided throughout all existing Group R -3 dwellings where a substantial remodel occurs or where the gross floor area of the building exceeds 8,000 square feet, Exception: When additional floor area does not exceed 1000 square feet. - Section 1027.6 is amended to add a new section 1027.6.1 to read as follows: 1027.6.1 Exit discharge surface. Exterior exit pathway surfaces shall be suitable for pedestrian use in inclement weather and terminate at a public way as defined in the California Building Code." and, be it further RESOLVED, that consistent with Section 13869.7(c) of the California Health and Safety Code, the Town Council makes the following findings in support of the modifications to Ordinance No. 23: 1. The modifications made by the Town of Danville delete requirements to install fire sprinkler systems beyond those already required by the International Fire Code and the California Fire Code. 2. Fire sprinkler systems add to the cost of construction for residential and commercial remodeling projects. PAGE 4 OF RESOLUTION NO. 125-2010 3. The San Ramon Fire Protection District provides outstanding fire protection service to Danville residents, as evidenced by the 2010 international accreditation issued by the Commission on Fire Accreditation International (one of only six such accreditations in the State of California) and the ISO 2 rating for the District (the second highest possible rating). 4. Given the outstanding fire service provided by the San Ramon Valley Fire Protection District, the small number of structure fires annually occurring within the Town and the fire safety standards already contained within the California Building Codes, the Town Council finds that the additional costs of including fire sprinklers as required by Ordinance No. 23 would constitute an undue burden on property owners within the Town.
